ORDINANCE NO. 2413 AN ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING SECTIONS 12.18 AND 12.15 OF THE CITY FIRE CODE AND SECTION 9.3 OF THE CITY BUILDING CODE TO REQUIRE AUTOMATIC SPRINKLER SYSTEMS IN MULTI-UNIT RESIDENTIAL BUILDINGS OF FOUR UNITS OR MORE AND TO MAKE VIOLATIONS OF THIS REQUIREMENT A MISDEMEANOR THE COUNCIL OF REDWOOD CITY ORDAINS AS FOLLOWS: Section 1. The City Council makes the following findings: 1. In recent years, the City has suffered a number of devastating fires to multi residential buildings lacking Automatic Sprinkler Systems (as defined in the 2013 California Fire and Building Codes at Section 202, "General Definitions') resulting in death, injury, property loss, and loss of certain housing stock.

06/08/2015 <br />such person, firm, or corporation shall be deemed guilty of a separate offense for <br />each and every day or po rtion thereof during which such violation exists and shall <br />be punished as set forth in Section 1.7A of the Redwood City Code. The act of <br />violating Section 903.2.13(e) shall include maintaining a property without an <br />Automatic Sprinkler System as required b y Section 903.2.13(e). <br />Section 5. <br /> Section 9.3 of Chapter 9 – Buildings, of the City Code, is amended <br />to read as follows: <br /> <br />Sec. 9.3. - VIOLATIONS AND PENALTIES: <br /> <br />A. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, <br />improve, remove, convert, demolish, equip, use, occupy or maintain any building <br />or structure in the City or cause the same to be done contrary to or in violation of <br />a ny code provision as adopted by this Chapter or any amendment thereto as <br />adopted by this Chapter. <br /> <br />B. Any person, firm or corporation, whether as principal, agent employee, or <br />otherwise, who shall violate or cause the violation of any of the provisions of the <br />codes or amendments adopted by this Chapter, or fail to comply with any order, <br />license or permi t made or issued thereunder, or who shall build or install in <br />violation of any detailed statement of specifications or plans submitted and <br />approved thereunder and from which no appeal has been taken, or who shall fail <br />to comply with such an order, license or permit as affirmed or modified by the <br />Council or by a court of competent jurisdiction within the time fixed therein, shall <br />severally, for each and every such violation and noncompliance thereof, shall be <br />punishable as provided in Section 1.7B of this Co de. The imposition of any one <br />penalty for any violation shall not excuse the violation or permit it to continue. <br />Each and every day a violation shall continue shall be deemed to be a separate <br />violation. Notwithstanding the foregoing, any person, firm or co rporation violating <br />Section 903.2.13 (e) regarding Automatic Sprinkler Systems shall be deemed <br />guilty of a misdemeanor, and each such person, firm or corporation shall be <br />deemed guilty of a separate offense for each and every day or portion thereof <br />during w hich such violation exists and shall be punished as set forth in Section <br />1.7A of the Redwood City Code. The act of violating Section 903.2.13(e) shall <br />include maintaining a property without an Automatic Sprinkler System as <br />required by Section 903.2.13(e). <br /> <br />C. The Building Official or the authorized representatives of the Building Official shall <br />have the authority to issue citations for violations of the codes or amendments <br />adopted by this Chapter, and all orders, licenses, certificates, permits, and plans <br />and specifications issued or approved thereunder. <br /> <br />Section 6. <br /> In recognition of the planning and resources necessary to <br />implement the requirements of this ordinance, compliance shall be voluntary for the first <br />five years but strongly encouraged.
