Description
ORDINANCE REPEALING CHAPTER 27 OF THE CODE OF THE CITY OF REDWOOD CITY AND ADDING CHAPTER 27 TO THE CODE OF THE CITY OF REDWOOD CITY, RELATING TO THE REGULATION OF SANITARY SEWERAGE AND STORM WATER DRAINAGE FACILITIES THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 27 of the Code of the City of Redwood City, as amended, entitled "Sanitary Sewerage and Storm Water Drainage Facilities", is hereby repealed. SECTION 2. Chapter 27 is hereby added to the Code of the City of Redwood City to read as follows: "CHAPTER 27

Such nuisance <br /> may be abated, removed, or enjoined, and damages <br /> assessed therefor, in any manner provided by law. <br /> "Section 27.132. Civil Assessments. Any User, <br /> permittee, or owner of Premises or other person who or <br /> which intentionally or negligently violates any <br /> requirement of this Chapter, or of any permit, <br /> directive, or order issued or made pursuant to this <br /> Chapter requiring the pretreatment of any industrial <br /> Waste which would otherwise be detrimental to the <br /> Sewerage Facilities or their proper and efficient <br /> operation and maintenance, or requiring the prevention <br /> of the entry of such Waste into the Sewerage Facilities <br /> may be civilly liable pursuant to the provisions of <br /> California Government Code Section 54740. In any such <br /> instance, the City Council may authorize the City <br /> Attorney to petition the Superior Court for the County <br /> of San Mateo to impose such civil assessments pursuant <br /> to said section. <br /> "Section 27.133. Misdemeanor. Any person <br /> violating, or causing the violation of any provision of <br /> this Chapter, or of any permit issued pursuant to this <br /> Chapter, shall be guilty of a misdemeanor, and upon - <br /> conviction thereof, shall be punishable as provided in <br /> Section 1.7(a) of this Code. Every day such violation <br /> shall continue shall constitute a separate offense. <br /> 88 <br />
