ORDINANCE NO ORDINANCE AMENDING THE TIME BY WHICH POLES AND OVERHEAD WIRES SHALL BE REMOVED AND UNDERGROUND SERVICE PROVIDED WITHIN UNDERGROUND UTILITY DISTRICT NO. 1994-1; AND ESTABLISHING THE USE OF UNDERGROUND CONVERSION ALLOCATION FOR UNDERGROUNDING UTILITIES FOR CERTAIN RESIDENTIAL PROPERTIES THEREIN PURSUANT TO DECISION BY THE PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA

Oral or Written <br /> <br />Name & Address of Obiector Obiection Nature of Objection <br /> <br /> NOW, THEREFORE: <br /> <br /> The Council of the City of Redwood City does ordain as follows: <br /> <br /> Section 1. The foregoing recitals are, and each of them is, true and <br />correct and the Council so determines. <br /> <br />Section 2. Section 5 of Ordinance No. 2084 is hereby amended to read: <br />"Section 5. Pursuant to Section 11.45(c) of the Code of the City of <br />Redwood City, the date by which the undergrounding of all overhead utilities, <br />including existing service drops, and the removal of all wood utility poles, <br />overhead wires, and associated structures from all streets, roads, alleys, or ways <br />shall occur within said district is hereby fixed as August 1, 1997. In the event <br />that any act required by this adicle or by an ordinance adopted pursuant to <br />Ordinance No. 2849, as amended by this Ordinance, cannot be performed within <br />the time provided on account of shortage of materials, war, restraint by public <br />authorities, strikes, labor disturbances, civil disobedience, or any other <br />cimumstances beyond the control of the actor, then the time within which such <br />act will be accomplished shall be extended for a period equivalent to the time of <br />such limitation." <br /> <br /> Section 3. Section 5.A. is added to Ordinance 2084 to read as follows: <br /> <br /> "Section 5.A. The utility company which undertakes underground <br />installation of its facilities shall use the underground conversion allocation <br /> <br />Ord-OO8 3 <br />FXS:djk <br />O9/23/96 <br /> <br /> 2120 <br /> <br /> <br />
