APR 1 2 1982 ORDINANCE ADDING CHAPTER 41 TO THE CODE OF THE CITY OF REDWOOD CITY RELATING TO FLOOD ZONE DEVELOPMENT THE COUNCIL OF REDWOOD CITY DOES ORDAIN, AS FOLLOWS: SECTION 1. Chapter 41 is hereby added to the Code of the City of Redwood City, to read as follows: FLOOD ZONE MANAGEMENT "Section 41.1. Title. This chapter shall be known as the Flood Zone Management Ordinance of the City of Redwood City. "Section 41.2. Findings and Purpose. <br /> "Section 41.14. Specific Standards for Subdivisions. <br /> ( a) In addition to requirements set forth in Section 41.10 <br /> and Sections 41.11, 41.12 or 41.13, and in addition to appli- <br /> cable requirements set forth in other chapters of this code, the <br /> following standards shall apply to subdivision developments pro- <br /> posed in accordance with chapter 30 of this code, which are to be <br /> located in areas of special flood hazard: <br /> " (1) All subdivision proposals shall have public <br /> utilities and facilities such as sewer, gas, <br /> electrical and water systems located and con- <br /> structed to minimize flood damage. <br /> " (2) All subdivision proposals shall have adequate <br /> drainage provided to reduce exposure to flood <br /> hazards. <br /> " (b) Base flood elevation data shall be provided along with <br /> the application for the flood zone development permit <br /> for all subdivision proposals. <br /> "Section 41.15. Other Regulations. Standards and regulations <br /> which appear elsewhere in this code shall not be abrogated, super- <br /> ceded or otherwise reduced by application of the standards set <br /> forth in this chapter, and specifically regulations regarding <br /> watercourses and flood control management which are contained In <br /> other chapters of this code shall remain in full force and effect. <br /> "Section 41.16. Variances. The Director of Public Works shall <br /> have the power to grant variances from the terms of this chapter. <br /> "Section 41.17. Prerequisites for Obtaining Variance of <br /> Requirements. ( a) A variance shall only be issued upon: <br /> "(1) A showing of good and sufficient cause. <br /> " (2) A determination that failure to grant the vari- <br /> ance would result in exceptional hardship to the <br /> applicant. <br /> " ( 3) A determination that the granting of a variance <br /> will not result in increased flood heights, addi- <br /> tional threats to public safety, extraordinary <br /> public expense, create a nuisance, cause fraud <br /> on or victimization of the public, or conflict <br /> with existing local laws or ordinances; and <br /> " (4) A determination that the variance is the minimum <br /> necessary, considering the flood hazard, to afford <br /> relief. <br /> -8- <br />
