1883 --------- - - NOV 7 1983 AN ORDINANCE AMENDING SECTIONS 5.1, 5.1.1, 5.2, 5.17, 5.20, 5.21, 5.22.5, 5.23, 5.63.1, 5.65 AND 5.91 OF, ADDING SECTION 5.24, DIVISION 4 (COMMENCING WITH SECTION 5.25) OF ARTICLE II AND SECTION 5.61 TO, REPEALING SECTIONS 5.6, 5.13, 5.14, 5.16, 5.22.1, 5.24, 5.24.1, 5.24.2, 5.24.3, DIVISION 3 (COMMENCING WITH SECTION 5.31) OF ARTICLE III, SECTIONS 5.61 AND 5.64 OF, AND RENUMBERING SECTIONS 5.25 AND 5.26 OF, THE CODE OF THE CITY OF REDWOOD CITY REGARDING PERMITS FOR DANGEROUS AND VICIOUS ANIMALS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5.1 of the Code of the City of Redwood City is hereby amended to read as follows: "Section 5.1. (a) Animal Control Shelter: Those facilities provided for the impounding of animals

<br /> t:GM:rb 7/14/83 <br /> _GM:rb 10/19/83R <br /> CGM:rb 10/24/83R <br />"Section 5.25.2. Revocation or Suspension. <br />" (a) Grounds for revocation or suspension. Subject to <br />the provisions of subsection (c) any permit issued <br />pursuant to this article may be revoked or at the <br />discretion of the Animal Control Officer suspended for <br />a period of up to three (3 ) months, if the Animal <br />Control Officer finds any of the following to be true: <br />" (1) The permittee, or any person caring for or having <br />control, or his agent has been convicted of any <br />offense involving the violation of local animal <br />ordinances, the Penal Code, or is in violation of any <br />zoning, health and safety or building ordinance <br />relating to the keeping of any animals; or <br />"(2) The permittee has failed to keep and maintain the <br />premises or housing for the animals in a clean and <br />sanitary condition; or <br />" (3) The permittee has failed to provide the animal <br />with proper food, water, shelter, care or attention; <br />or <br />" (4) The permittee has violated any rules, regulations <br />or conditions adopted by the Animal Control Officer as <br />necessary to insure the animal will not endanger the <br />peace, health or safety of any person or property; or <br />"(5) The permittee has changed the location of his <br />residence or his place of business or sells, assigns, <br />transfers, donates, leases, or otherwise disposes of <br />the animal for which the permit was issued. <br />" (b) With respect to guard dogs, any violation of "The <br />Dog Act of 1969", Health and Safety Code Sections <br />2598, 25984.1, 25984.2, 25984.4 (a) , (b) , (c) , 25980, <br />25981, and 25987 shall result in the suspension of <br />permit pending investigation by the Animal Control <br />Officer, pursuant to the provisions of Subsection (c) <br />of this section. <br />" (c) If, after investigation, the Animal Control <br />Officer concludes that it is probable that one or more <br />of the above grounds for revocation has occurred, he <br />shall cause written notice thereof to be transmitted <br />by registered mail to the address of the permittee. <br />Said notice shall specify the grounds of possible <br />denial of the permit and shall specify a date and time <br />for an informal hearing to be held before an Animal <br />Control Officer. Said date shall be not less than <br />five days subsequent to the date the notice is mailed. <br /> 13 <br /> .- ----. <br />
