1883 --------- - - NOV 7 1983 AN ORDINANCE AMENDING SECTIONS 5.1, 5.1.1, 5.2, 5.17, 5.20, 5.21, 5.22.5, 5.23, 5.63.1, 5.65 AND 5.91 OF, ADDING SECTION 5.24, DIVISION 4 (COMMENCING WITH SECTION 5.25) OF ARTICLE II AND SECTION 5.61 TO, REPEALING SECTIONS 5.6, 5.13, 5.14, 5.16, 5.22.1, 5.24, 5.24.1, 5.24.2, 5.24.3, DIVISION 3 (COMMENCING WITH SECTION 5.31) OF ARTICLE III, SECTIONS 5.61 AND 5.64 OF, AND RENUMBERING SECTIONS 5.25 AND 5.26 OF, THE CODE OF THE CITY OF REDWOOD CITY REGARDING PERMITS FOR DANGEROUS AND VICIOUS ANIMALS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5.1 of the Code of the City of Redwood City is hereby amended to read as follows: "Section 5.1. (a) Animal Control Shelter: Those facilities provided for the impounding of animals

<br /> ~GM:rb 7/14/83 <br /> Gt.1: rb 10/19/83R <br /> CGM:rb 10/24/83R <br />of this state or any city or county, or by the laws or <br />postal regulations of the United States, or when he is <br />on such property upon invitation, express or implied. <br />(2 ) An attack without provocation on another animal or <br />livestock which occurs off the property of the owner <br />of the attacking animal. <br />SECTION 2. Section 5.1.1 of the Code of the City of Redwood <br />City is hereby amended to read as follows: <br />"Section 5.1.1. (a) Responsibility: The chief of <br />animal control is responsible for the enforcement of <br />the provisions of this chapter and his duties shall <br />include, but not be limited to, the following: <br />(1) To administer the animal control shelter and keep <br />such records as may be required by law or by contract; <br />(2 ) To take up and impound animals which are in <br />violation of the provisions of this chapter, or for <br />the safe keeping of the animal to protect its health <br />and welfare; <br />(3 ) To remove and dispose of the carcass of any <br />animal found on any public highway, street, or alley <br />or other public place; <br />(4 ) To quarantine animals and to cooperate with the <br />health officer with respect to such quarantine. <br />" (b) Authority to Arrest. In the performance of their <br />duties the chief of animal control and those officers <br />who have qualified as humane officers pursuant to <br />Section 607(f) of the Civil Code, are hereby <br />authorized and empowered to issue notice to appear in <br />court pursuant to Chapter 5(c) (commencing with <br />Section 853.5) of Title 3 of Part 2 of the Penal Code, <br />for violations of provisions of this chapter and all <br />other ordinances of the city and the laws of the state <br />relating to the care, treatment, impounding, control, <br />regulation or prohibition of animals or for the <br />prevention of cruelty thereto. <br />SECTION 3. Section 5.2 of the Code of the City of Redwood <br />City is hereby amended to read as follows: <br />"Section 5.2. It shall be unlawful, and it is declared <br />to be a nuisance for any person other than a duly <br /> 3 <br /> .- ....~.,.... - <br />
