A Planned Development Permit is required to establish a condominium map. No <br />deviations are being requested as part of the Planned Development Permit. The <br />Project would be required to form a homeowners association (HOA) and <br />develop covenants, conditions, and restrictions (CC&Rs), which would run with <br />the land and ensure ongoing maintenance of shared common space. <br />The proposed townhomes were designed to maximize density, open space, and <br />covered parking at the site. The 10 units are arranged in a single building, which <br />maintain a similar development pattern to adjacent apartment buildings in the <br />vicinity. Building would be constructed with architectural grade exterior materials <br />and the building configuration allows for a shared driveway to reduce impacts to <br />vehicular accessibility from Woodside Road. <br />B. Findings for Modifications to Development Standards. Modifications <br />may be granted if it is determined that the proposed development will <br />provide an environment of physical and functional desirability, in <br />harmony with the character of the surrounding neighborhood or <br />district. <br />No modifications to development standards are requested. <br />Section 8. Condominium Permit CP2019-005: (Article XI of the Subdivision <br />Ordinance): The Planning Commission finds that: <br />Pursuant to Article XI of Chapter 30 of the Municipal Code (Subdivisions), the <br />Project also requires approval of a Condominium Permit. The Project site is comprised <br />of two parcels that would be merged into one for condominium purposes. Upon <br />approval of the Tentative Map, the Project site would consist of one parcel that would <br />be subdivided for condominium purposes. Section 30.130 states: <br />"While condominium and community apartment projects present benefits in the <br />nature of increased amenities, opportunities for dwelling ownership and leisure <br />time, the special nature of such projects creates conditions that may result in <br />neglect, deterioration and lack of maintenance, causing negative impact upon <br />health, safety, welfare and economic prosperity of the City and its citizens. <br />Because of the unique nature of the problems created by condominium and <br />community apartment projects, it is the express intent of the City to treat such <br />projects differently from other types of multifamily dwellings and to establish <br />rules and standards thereof, regulating the construction of, and conversion to, <br />condominium projects and community apartment projects in the City." <br />Page 8 of 26 <br />ATTY/RESO.0098/PC RESO 910 WOODSIDE ROAD <br />REV: 10-09-19 PR <br />
