DES:dj' ~1/30/95 (043/41) <br /> <br />(h) The owners of more than one-half (1/2) of the area of <br /> the property in the proposed District subject to the <br /> special benefit assessment proposed to pay for the <br /> costs and expenses of maintaining and operating the <br /> above-described improvements, did not, at or prior to <br /> the time fixed for the above-mentioned hearing, file <br /> written protests against the formation of the District, <br /> the boundaries thereof, the benefit formula or <br /> formulae, or the fairness thereof, or any or all of the <br /> matters upon which protests might have been made; <br /> <br />(i) The costs and expenses of maintaining and operating any <br /> and all of the public improvements of a local nature <br /> described in Exhibit C have not adequately been <br /> financed and provided for, and the public interest and <br /> convenience require that the costs and expenses of <br /> maintaining and operating said public improvements, <br /> including the costs of necessary repairs, replacements, <br /> fuel, power, electrical current, care, supervision and <br /> any and all other items necessary for the proper <br /> maintenance and operation thereof, should be assessed <br /> upon and within the District; said District, and any <br /> parcels of real property therein contained, will be <br /> benefited by the maintenance and operation of said <br /> local public improvements; and said District should be <br /> formed and established. <br /> <br /> 4 <br /> <br /> <br />
