6.A. - Page 10 of 16 <br />EXHIBIT "A" <br />SCOPE OF SERVICES <br />1. Contractor will provide temporary staffing agency services on an as -needed <br />basis to the City's Administrative Services Department. <br />2. Contractor will provide the City with competent personnel who possess the <br />qualifications to perform the services described in Exhibit B "Work Duties, Skills, <br />and Abilities". <br />3. Contractor will ensure a sufficient number of competent and qualified personnel <br />are readily available to meet the City's temporary staffing needs. <br />4. Contractor will conduct the following background checks of personnel assigned <br />to perform services under this Agreement (Assigned Personnel), at no additional <br />charge to the City. <br />To the extent permitted by applicable law, Contractor will have a third party <br />vendor (a) complete a seven (7) year criminal background investigation for all <br />state felony convictions and pending charges and state misdemeanor convictions <br />and pending charges for crimes of dishonesty or violence in every county where <br />Assigned Personnel has resided or worked within the U.S. in the last seven (7) <br />years as stated on his or her application, (b) perform a Social Security <br />Verification and Trace, , and (c) perform a seven (7) year criminal background <br />investigation by having the third party perform a search of its private database of <br />U.S. national criminal records searching for felony convictions and misdemeanor <br />convictions for crimes of dishonesty. City understands and agrees that the third - <br />party vendor's database of U.S. national criminal records (i) is maintained by the <br />third -party vendor and not a governmental entity, (ii) is an incomplete <br />aggregation of criminal records and (iii) will not reveal or identify all criminal <br />convictions. If City requests a copy of the results of the foregoing checks (the <br />"Report"), City agrees to keep the Report strictly confidential and to use the <br />Report for employment purposes only. <br />a. Contractor guarantees City's satisfaction with Contractor's Assigned Personnel <br />services by extending to City an eight (8) hour guarantee period. If, for any <br />reason, City is dissatisfied with the Assigned Personnel assigned to City, <br />Contractor will not charge for the first eight (8) hours worked, provided Contractor <br />is allowed to replace the Assigned Personnel. Unless City contacts Contractor <br />before the end of the guarantee period, City agrees that Contractor's Assigned <br />Personnel is satisfactory for purposes of this guarantee. <br />5. Contractor shall comply with all applicable local, state, and federal laws and <br />regulations prohibiting discrimination and harassment.
