DES:rg 08/22/95 (056/40) <br /> <br />community center, park and recreation facilities and <br />appurtenances, to be used in conjunction with an elementary <br />school to be constructed, operated, and maintained by the <br />Belmont Elementary District (collectively, the "Project"); and <br /> <br /> WHEREAS, the City of Redwood City and the Belmont <br />Elementary District, a public school district in the County <br />of San Mateo, entered into that certain agreement dated June <br />9, 1995, entitled "Joint Use Agreement Between the City of <br />Redwood City and the Belmont Elementary District Regarding <br />Joint Use of the Sandpiper Park Site" (the "Joint Use <br />Agreement"), pursuant to the provisions of Government Code <br />Section 6500 et seq.; and <br /> <br /> WHEREAS, the City is authorized to acquire real <br />property by eminent domain pursuant to the Charter of the <br />City of Redwood City, Government Code Section 37350.5, and <br />the provisions of Government Code Section 6500, et seq., as <br />provided in the Joint Use Agreement; <br /> <br /> WHEREAS, notice has been given pursuant to the <br /> provisions of Code of Civil Procedure Section 1245.235 of hearing <br /> to be held on the adoption of this resolution and the matters <br /> referenced in Code of Civil Procedures Section 1240.030; and <br /> <br /> WHEREAS, on August 28, 1995, said hearing was held at <br /> which time all persons whose names and addresses appeared on the <br /> last equalized County Assessment Roll pertaining to the Egret <br /> Lane and Sandpiper Park Parcels, and all other interested <br /> <br /> <br />
