8.A. - Page 11 of 45 <br />5. Time/date when permit application was completed <br />The site would initially be open from 5:00 p.m. to 9:00 a.m., seven days per week. Currently, under state <br />law, the provision of a twenty-four hour, seven day per week (24/7) facility may bestow tenancy rights <br />upon RV residents. In order to avoid the unintended bestowal of tenancy rights, RV residents would be <br />only be allowed to park in the City's Safe Parking lot overnight but would need to leave the facility by 9:00 <br />a.m. each day. <br />Ultimately, based on feedback from RV residents and conversations with other jurisdictions, the eventual <br />goal would be to have the Safe Parking Lot open twenty-four hours per day/seven days per week. <br />A pilot 24/7 parking facility program authorized by the State has been underway in several other <br />jurisdictions. State Assembly Members Berman and Ting have introduced legislation (AB 2553) that would <br />enable all California jurisdictions to establish a 24/7 parking facility without bestowal of tenancy rights. <br />City staff has been instrumental in recommending language to the legislators. <br />At its June 8, 2020 meeting, the City Council authorized staff to send a letter to Assembly Members <br />Berman and Ting in support of this approach.
