Rather, RVs are now primarily regulated via the 72 -hour ordinance, which is of limited use as a regulatory tool. Staff is proposing Council adopt an ordinance that would prohibit overnight parking of RVs and would allow the City to address two issues: 1) the effect of large RVs on already impacted parking in residential neighborhoods and business districts; and 2) the use of RVs on City streets as a shelter alternative. In addition to addressing the parking -related issues discussed above, staff recommends the repeal of Redwood City Municipal Code 20.227 —Sleeping in Vehicles. The language of this ordinance closely tracks a City of Los Angeles ordinance that was found unconstitutionally vague, and therefore unenforceable, by the Ninth Circuit Court of Appeals in 2014. Based on this ruling the City Attorney advised the Police Department that it should no longer be enforced. Leaving an unenforceable ordinance in the municipal code creates confusion and frustration in the community when they see it is not enforced and do not know the underlying reasons. Therefore, it should be repealed. RV owners participating in the RV Parking Permit and Safe Parking Facility Programs would be able to continue to park on City streets, but would be subject to program rules and restrictions that are intended to dramatically lessen the impacts of RV parking on the surrounding community. Further, RV Parking Permit holders will still need to obey all other parking -related ordinances throughout the City. RV users who choose not to participate in and/or are ineligible for the programs would be required to find parking options other than on City streets.
