Under CEQA, an agency may <br />combine several exemptions to find an entire project exempt. Courts have upheld the <br />application of categorical exemptions, even when they were not the basis upon which the <br />agency approved the project, because the exemptions apply as a matter of law. <br />"Common Sense" Exemption (15061(b)(3)) - For the Retail Cannabis permitted by right, <br />the "common sense" exemption found in CEQA Guidelines Section 15061(b)(3)) applies. It <br />can be seen with certainty that there is no possibility that allowing Retail Cannabis may have <br />a significant impact on the environment. Retail cannabis storefront uses proposed by the <br />Ordinance are defined similarly as general retail uses that are currently permitted by right <br />in the Downtown Precise Plan (DTTP), Mixed -Use Corridor (MUC), Mix -Use Neighborhood <br />(MUN), Mixed -Use Transition (MUT), Mixed -Use Waterfront (MUWF), General Commercial <br />(GC), Neighborhood Commercial (CN), and Light Industrial Incubator (LII) Zoning Districts. <br />Additionally, they pose the same environmental impacts, as further explained throughout <br />this memo. <br />Page 2 of 5 <br />128 <br />
