California Water Service Company: To identify potential new local water supply opportunities and capital projects that will provide supply reliability to our Bay Area Peninsula customers. City of Redwood City: To identify potential new water supplies, and enhance the quality of recycled water to promote beneficial uses. San Francisco Public Utilities Commission: To identify potential new water supply opportunities to serve existing and new customer demands, including the Cities of San Jose and Santa Clara. 6. WHEREAS, the Parties have worked collaboratively since 2016 under a separate agreement, dated November 3, 2016, which was subsequently amended in April 2018 and expired in April 2020, to develop a coordinated plan for potable reuse in the San Francisco Bay Region, known as the Potable Reuse Exploratory Plan ("PREP"), through the PREP Phase 1 Initial Study and PREP Phase 2 Concept Study; and 7. WHEREAS, the PREP Phase 1 Initial Study considered potable reuse alternative concepts, including reuse through groundwater replenishment and Reservoir Water Augmentation ("RWA") at the SFPUC's Crystal Spring Reservoir ("CSR") and Cal Water's Bear Gulch Reservoir; and 8. WHEREAS, the PREP Phase 2 Concept Study further defined the concept of a RWA project at CSR and included a parallel study that provided a preliminary evaluation of a potable reuse project that augments CSR with purified water; and 9. WHEREAS, the Parties recognize additional study is needed to establish the feasibility of the PREP, and SVCW has entered into a contract with a consultant ("Consultant") under which the Consultant will conduct the PREP Phase 3 Feasibility Study, as described in the Consultant Scope of Work developed and approved by the Parties, which is attached hereto and incorporated herein as Attachment 1; and 10. WHEREAS, SVCW and the Consultant have entered into a separate agreement concerning the Consultant Scope of Work and Consultant's obligations under said contract with respect to its performance of the Consultant Scope of Work ("SVCW- Consultant Agreement"), which is incorporated herein as part of Attachment 1; and 11. WHEREAS, the Parties desire to enter into this Agreement setting forth the respective roles and responsibilities of the Parties, and the cost sharing allocations and procedures, regarding the PREP Phase 3 Feasibility Study; NOW, THEREFORE, in consideration of the recitals and mutual obligations of the Parties herein expressed, the Parties agree as follows: REV: 10-06-2020 MI 27 ATTY/AGR.2020.216/MOA- SVCW, SFPUC, BAWSCA, Cal -Water, City of San Mateo (Page 2 of 36)
