DEFINITIONS <br />The following definitions apply to this Agreement: <br />a) "Consultant" means the consulting firm Kennedy and Jenks, which has been <br />retained by the Contracting Entity to perform the Consultant Scope of Work for the <br />PREP Phase 3 Feasibility Study attached to this Agreement as Attachment 1. <br />b) "Contract" means the contract between the Contracting Entity and the Consultant <br />under which the Consultant will perform the Consultant Scope of Work for the <br />PREP Phase 3 Feasibility Study, and the SVCW-Consultant Agreement, <br />collectively. <br />c) "Contracting Entity" means Silicon Valley Clean Water, which has been designated <br />by all Parties as the entity to retain the Consultant for the PREP Phase 3 Feasibility <br />Study and to administer and manage the Contract with the Consultant. <br />d) "Direct Potable Reuse" or "DPR" means tthe delivery of purified water to a <br />drinking water plant or a drinking water distribution system without an <br />environmental buffer. Additional treatment, monitoring, and/or an engineered <br />buffer(s) would be used in place of an environmental buffer to provide equivalent <br />protection of public health and response time in the event that the purified water <br />does not meet specifications <br />e) "Indirect Potable Reuse" or "IPR" means the addition of recycled water to augment <br />groundwater or surface waters. Groundwater and surface waters are considered <br />environmental buffers for providing public health protection benefits, such as <br />contaminant attenuation dilution, and time to detect and respond to failures before <br />final treatment and distribution. Indirect potable reuse can use advanced treated <br />water, but can also be accomplished with tertiary effluent when applied by <br />spreading (i.e., groundwater recharge) to take advantage of soil aquifer treatment <br />(SAT). <br />f) "Party" or "Parties" means BAWSCA, Cal Water, Redwood City, San Mateo, <br />SFPUC, and SVCW, either individually or collectively. <br />g) "Potable Reuse" means the production of raw water suitable to drinking water <br />standards administered by the California Division of Drinking Water through <br />advanced purification of treated wastewater via Indirect Potable Reuse or Direct <br />Potable Reuse. <br />h) "Potable Reuse Exploratory Plan" or "PREP" means the coordinated plan to <br />explore and evaluate Potable Reuse in the San Francisco Bay Region being <br />developed by the Parties under this Agreement. <br />i) "PREP Phase 3 Feasibility Study" means the study that will be prepared through <br />this Agreement and the Contract with the Consultant to explore and evaluate the <br />REV: 10-06-2020 MI <br />ATTY/AGR.2020.216/MOA- SVCW, SFPUC, BAWSCA, Cal -Water, City of San Mateo (Page 3 of 36) <br />
