This finding is based on the entire record of <br />proceedings for the Project, including but not limited to the discussion and analysis <br />set forth on pages 3.2-34 through 3.2-38 of the DEI R, which includes a full statement <br />of the impact and applicable mitigation measures and is hereby incorporated herein <br />in its entirety. <br />5. Biological Resources Impact 13I0 -4a: The project could have a substantial <br />adverse effect, either directly or through habitat modifications, on any species identified as <br />a candidate, sensitive, or special -status species in local or regional plans, policies, or <br />regulations, or by the California Department of Fish and Game or U.S. Fish and Wildlife <br />Service. <br />Mitigation Measures. Mitigation Measures 13I0-1 and 13I0-2 will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact 13I0 -4a. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measures 13I0-1 and 13I0-2 into the <br />Project would substantially lessen the severity of Impact 13I0 -4a, such that this <br />potential impact would be less than significant, because Mitigation Measure 610- <br />1 requires surveys to determine the presence of nesting bird and if active nests are <br />identified, development of construction -free buffer zones. Mitigation Measure 13I0-2 <br />requires preconstruction surveys to determine the presence of roosting bats and if <br />active bat roosts are identified, development of a suitable buffer or if applicable, a <br />bat mitigation and exclusion plan to compensate for lost roost. This finding is based <br />on the entire record of proceedings for the Project, including but not limited to the <br />discussion and analysis set forth on pages BIO 4.4-2 through BIO 4.4-4 of the Initial <br />Study, which includes a full statement of the impact and applicable mitigation <br />measures and is hereby incorporated herein in its entirety. <br />6. Cultural Resources Impact CR -1: The Project would result in a substantial adverse <br />change in the significance of a historical resource. <br />Mitigation Measures. Mitigation Measures CR -1a, CR -1b, CR -1c, CR -1d, <br />and CR -1 a will be implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact CR -1. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measures CR -1 a, CR -1b, CR -1c, CR - <br />1 d, and CR -1 a into the Project would substantially lessen the severity of Impact CR - <br />1 by limiting the loss of historical information associated with demolition of the <br />Perry's Fuel & Feed Shed, however, it would not prevent the loss of a significant <br />historical resource, and this impact remains significant and unavoidable.
