6.D. - Page 2 of 12 <br />(2) Allowing the use of the City public right-of-way, such as adjacent sidewalks and street <br />parking, for restaurant outdoor dining in the Downtown <br />(3) Allowing retail centers and businesses (citywide) to use portions of their private parking <br />lots for outdoor dining, carhop dining and take-out meals <br />The June 15 Proclamation also modified City permitting requirements to allow restaurants to immediately <br />apply for a Temporary Outdoor Dining Permit (COVID-19) for use of public and private property for <br />outdoor dining with no application fee. <br />On June 22, the City Council ratified the Proclamation. The City Council approved the street closures <br />referenced below and staff implemented the street closures and designated parking spaces for outdoor <br />dining for grab -and -go delivery on June 26. The initial term for the outdoor dining program was from June <br />26 to September 30. <br />The City's pandemic response strategy is framed as the Three Rs: to Respond to immediate community <br />needs, to Restore community cultural, economic and social vitality, and to Reimagine public services in <br />light of evolving community needs and financial resources. To further the goal to Restore community <br />vitality, the City Manager issued a Proclamation on September 1 that allows retail businesses to apply for <br />a Temporary Outdoor Business Permit to operate outdoors on private property and on City sidewalks. <br />Under the Proclamation, fitness centers dance studios and group trainings may operate outdoors on <br />private property or can apply for a separate permit to operate in a City park. Furthermore, the <br />Proclamation allows personal care businesses such as hair and nail salons to operate outdoors on private <br />property. <br />On September 14, 2020, the City Council adopted a resolution ratifying the September 1, 2020 <br />Proclamation by the Director of Emergency Services allowing Temporary Outdoor Business Activity during <br />the Covid-19 emergency and on this same date, City Council adopted a resolution authorizing the <br />temporary closure of City streets to be extended through January 31, 2021. <br />In November 2020, Restauranteurs inquired about the usage of tents and heaters for outdoor dining <br />during the winter months. Staff in the City's Engineering Division and Fire Department developed a <br />business winterization permitting program that allows restauranteurs to apply for permits to use tents, <br />heaters and other outside enclosures by restaurants. <br />Staff and the task force review the program bi-monthly and have made minor modifications to downtown <br />street closures based on input from businesses.
