ORIGINAL <br /> AMENDMENT NO. 2 <br /> TO THE AGREEMENT FOR INFORMATION <br /> TECHNOLOGY SUPPORT 2011 <br /> Between the City of East Palo Alto and the City of Redwood City <br /> This Amendment No. 2 is effective as of the 12th day of February, 2012, <br /> amending the agreement dated June 23, 2011 (the "Agreement") by and between the <br /> City of East Palo Alto, a municipal corporation of the State of California ("EPA"), and the <br /> City of Redwood City, a charter city and municipal corporation of the State of California <br /> ("Redwood City") (collectively, the "Parties") for performing Information Technology <br /> Support services. <br /> RECITALS <br /> A. On June 23, 2008, the Parties executed an Agreement for information <br /> technology support that became effective on July 1, 2008, for a three-year <br /> term ending June 30, 2011; and <br /> B. On June 30, 2011, the Parties executed Amendment No. 1 to the <br /> Agreement extending the term of the Agreement for an additional three <br /> years effective on July 1, 2011 for a term ending June 30, 2014; and <br /> C. The Parties wish to amend the scope and increase the agreement amount <br /> in order to support the development of the rent stabilization program <br /> management application during Fiscal Years 2011-2012 and 2012-2013. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. In addition to those services contained in the Agreement, as may have <br /> been amended from time to time, Redwood City will provide those <br /> services related to the rent stabilization program management application <br /> more particularly described in Exhibit "A," attached hereto and <br /> incorporated herein. <br /> 2. EPA will pay Redwood City for the work associated with those services <br /> described in Exhibit "A" on an hourly basis. Redwood City shall perform <br /> such services at the direction and within the discretion of the Rent <br /> Program Administrator, subject to the maximum associated charges <br /> described below. The hourly rate with respect to each fiscal year is as <br /> follows: <br /> Fiscal Year 2011-12: One Hundred Forty and 55/100 Dollars ($140.55) <br /> per hour for a maximum of four hundred eighty-eight (487.6) hours, in an <br /> amount not to exceed $68,532.00 for services from July 1, 2011 to <br /> February 12, 2012; plus One Hundred and Ten Dollars ($110.00) per hour <br /> Page 7 of 7 <br />
