there are any New Tenancy forms that were required during the prior calendar <br /> year that were not submitted . <br /> 19. Provide spreadsheets twice during the 2012-13 program year to assist in <br /> determining lack and sufficiency of registration information, and the payment of <br /> all fees and penalties required to issue Certificates of MAR or permit future rent <br /> increases. This will provide the means for identifying specific units: <br /> a) for which an Initial and/or Annual Registration statement was filed , but all <br /> fees or non-waived late penalties have not been paid; <br /> b) for which Initial and Annual registration fees and non-waived late penalties <br /> have been paid, but sufficient Initial and/or Annual Registration information <br /> has not been submitted; <br /> c) for which fees have been paid, and sufficient Annual and Initial <br /> registration; and information has been submitted, but no certificate has yet <br /> been issued (this will be a means for Administrator to identify units for <br /> which certificates must be issued, or the database updated) <br /> 20.Assist Rent Program staff in developing a procedure and program the database <br /> to determine if any "banking" of rents exists and record the amount and years <br /> banking occurred. Determine if MAR and any "banked" rent amount would <br /> exceed 10% of current rent, and if so, populate a notice to the owner and tenant <br /> to notify them of this limitation on the amount permitted to be taken. (Note: <br /> Section 10.1 of the RSO, sets limits on the banking of rent increases as follows: If <br /> a rent increase that is authorized by this section is not implemented in the year <br /> that it is authorized, it may be implemented in future years, subject to the <br /> following conditions and limitations: 1) the overall rent increase in any one year <br /> pursuant to the CPI-based rent adjustment and the banking adjustment <br /> authorized pursuant to this section may not exceed 10%; 2) by April 2011 and by <br /> February 1 of each year after 2011, the landlord has provided an annual notice <br /> to the tenant that lists which, if any, authorized rent increases have not yet been <br /> implemented; 3) the right to bank rent increases shall not include the right to <br /> impose rent increases authorized prior to the last date that a rent increase for <br /> the unit could have been implemented pursuant to the Costa-Hawkins Act; and <br /> 4) a landlord may not bank increases in rent from more than three annual <br /> general adjustments during occupancy by the same tenant.) <br /> 21.Program the Fee database for 2013 Annual registration fees, to record balances <br /> unpaid from 2012, including any penalties due, and approved waiver of late <br /> payment penalties for Initial and previous Annual registration fees. <br /> 22.Program the data fields in the Annual registration spreadsheet to be used for <br /> 2013 Annual Registration for dates, dollar amounts, and general field entries and <br /> to make calculations for net rent. <br /> 23.Program the database to generate a notice to tenants when a unit is entered as <br /> exempt stating the basis for the exemption claim filed by their landlord. <br /> Page 5 of 7 <br />
