Lessee shall select a qualif�ed architect <br /> and general contractor to complete improvement o� the Premises in accordance <br /> with plans and specifications app�oved by Lessee and Lessor ("P1ans and <br /> Specifications"} using only iicensed contractors and in accordance with Buifding <br /> Codes and other government laws and regulations, including, without limitafion, <br /> the Americans with Disab�lities Act {"ADA"). <br /> 10.3 Lessee shall submit capies of its' contractors' and subcontractors' insurance <br /> documents evidencing #he coverage provided and naming the Lessee as <br /> additional insu�ed for their contractors' or subcontractors'work. <br /> 10.4 Lessee shalf pay, when due, a!I claims for labor or materials furnished or a1leged <br /> to have been furnished to or for Lessee, at or for use in the Premises, which <br /> claims are or may be secured by any mechanics' or materia� men's fiens agains# <br /> the Premises or any interest therein. Lessee sha11 give Lessor not fewer than ten <br /> �10} days' notice prior to the commence�ent o# a�y work in the �'remises, and <br /> Lessor shal! have the right to post notices of non-responsEbi(ity En or on the <br /> � Premises as provided by law. lf�essee shall, in good faith, contest the validity ofi <br /> any such lien, cfaEm or demand, �hen Lessee shall, at its sole expense defend <br /> itself and Lessor against the same and shall pay and satisfy any such adverse <br /> judgment that may be rendered #hereon, before the en�orcement thereof against <br /> the Lessor or the Premises. However, if Lessor shafl require, Lessee shafl <br /> furr�ish to �essor a surefiy bond satisfactory to Lessor in an amount equal to such <br /> confiested fien claim or demand, indemni€ying Lessor against liability and holding <br /> the Premises free from the efFect of such lien or claim. In addition, Lessor may <br /> requir� �essee to pay Lessor`s a�torneys' fees and costs in participating in such <br /> action if Lessor shalf d�cide it is in its besfi interest to do so.
