As you are well aware.. it is u.ltimately your
responsibUity as the applicant property owner and business administrator to secure an
necessary approvals of entitlements to ensure the safe and legal operation ,of your
school Dnorto occupancy. On August 7,2.007, 'you submitted an application for a Use
Permit for' a proposal to add a K-12 school and child care facility at an existing church
site I.oealed at th~ abov.e-referenced property. Approximately one week after your
submittal, you verbally requested that the City issue a Temporary Use Permit to anow
commencement .ofschool operations for the fall semester, and you were informed that
your application was incom.plete .and that once deemed complete a pubHc hearing would
be required as part of that review, thereby leaving insufficient time to proces.s the
application under your time constraints. Furthermore, you as the representative of the
church and school were also .advis.ed that there is no guarantee that you would receive
ap.prova1 of any.or aU of.the prop.osed uses and intensities thereof. Against City advice,
you moved forward with the opening of the K-12 sch06t-(with a current ..enroJlment of
,approximate.1y 101 students) without first securing City approval of'aUse :Permit Since
then the City" consistent wlthstandard Gity practices relating to code compliance1 .has
been workin.g di.lige.ntly 'with you and concerned 'neighb.ors to ensure the health and
safety of all occupants and to minimize impacts to the neighborhood as we ,continue
with the review:proce~.

'~~.
I
{
