<br />7A <br />ATTACHMENT 1Page 5 <br /> <br />at the public hearing. The public hearing was held by the Zoning Administrator on March <br />18, 2009 to gather testimony for this project. Prior to the hearing, staff received <br />numerous letters of opposition and at the hearing seven individuals spoke in opposition <br />to the project, based on concerns which related to a lack of on-site parking and when <br />vehicles were parked on-site the vehicles impeded the pedestrian path of travel along <br />the Murray Court right-of-way (due to a lack a sidewalk and curb). Concerns also <br />included, but were not limited to potential illegal activity, and patrons of the proposed <br />business potentially parking and/or driving through the adjoining residential streets, as <br />well as the hours of operation. In an effort to address neighborhood concerns, the scope <br />of the use has been reduced from eight therapy rooms to four therapy rooms. The <br />interior space behind the storefront along Woodside Road is also expected to be active. <br />rather than be used for private rooms with darkened windows, which would result in an <br />inactive storefront. Lastly, the applicant's proposed hours of operation were reduced as <br />a condition of approval from 10AM to 9PM (and extend closing time to potentially 10PM <br />at a later date), seven days a week to 10AM to 8PM, seven days a week. <br /> <br />The Zoning Administrator's decision was appealed on May 11, 2009. The appeal was <br />heard by the City Council on July 13, 2009 and at the meeting, after taking testimony the <br />City Council directed staff to limit the hours of operation and to tenn the Use Permit for <br />24 months. The Notice of Official Action was revised to reflect Council's direction and <br />Use Permit was approved based on the following findings and subject to the conditions of <br />approval listed below: <br /> <br />FINDINGS: <br /> <br />1. The establishment, maintenance, and operation of the proposed use will not, under the <br />circumstances of this case, be detrimental to the public health, safety, peace, morals, <br />comfort, or general welfare of persons residing or working in the neighborhood because <br />the strict application of the conditions of approval ensure that the use will be maintained <br />in a clean, attractive condition at all times and the hours of operation are compatible to <br />adjacent commercial uses along the Woodside Road corridor. As previously stated, the <br />scope of the business, namely the number of therapy rooms, staff size and hours of <br />operation, has been reduced to address parking concerns. <br /> <br />2. The establishment and operation of the proposed use will not be detrimental or injurious <br />to property or improvements in the neighborhood because the proposed hours of <br />operation, staff size and other conditions of approval for the business will insure the <br />scale of the project is consistent with other commercial businesses along the Woodside <br />Road corridor and the adjoining residential neighborhood. <br /> <br />3. The establishment and operation of the proposed use will not be detrimental or injurious <br />to the general welfare of the City because the proposed business is considered an <br />amenity and it will offer a service to the residents and visitors of Redwood City <br />consistent with the purpose of the General Commercial Zoning District. <br /> <br />Moreover, the property was constructed in the 1950s, under alternative parking <br />requirements. As such, the property is considered Anon-conforming" with respect to <br />current parking requirements. Current parking requirements would require a total of <br />eight on-site parking spaces (two covered spaces for the apartment and six for the <br />commercial space). <br /> <br />In accordance with the conditions of approval the property owner will be required to <br />remove the existing fence enclosure and reconfigure the parking lot in a manner that <br /> <br />Page 2 of 5 <br />
