<br />7A <br />ATTACHMENT 1Page 6 <br /> <br />promotes a safe and more manageable parking lot. The property, after the fence <br />enclosure is removed, will contain a total of six on-site parking spaces (one covered <br />space and five spaces within the parking lot). Furthermore, based on the specific use, <br />staff size and the number of private therapy rooms and the amount of parking provided <br />on-site, this business can be controlled to comply with the parking demand generated by <br />it. Lastly, as part of this Use Permit, the property owner will be making exterior <br />improvements to the property, which include re-stripping the parking lot, removing the <br />barbed-wire fencing, planting landscaping and making the trash enclosure accessible <br />and usable by the tenants. <br /> <br />4. As previously described, the City has a specific permit process to establish a massage <br />business within city limits. This process has been in-place for the last five years and <br />allows the City to strictly control and limit massage establishments that may offer illegal <br />services. The process includes a background check by the Police Department as well as <br />a review of the land use implications by the Planning Division. In this case, the <br />Redwood City Police Department has checked numerous sources and has found no <br />indication that this business owner is operating an illegal business. Furthermore, it <br />appears that the applicant's business in Pleasant Hill, California has been operating free <br />of any known violations. <br /> <br />CEQA STATUS: <br />The proposed project is considered categorically exempt from the requirements of the California <br />Environmental Quality Act Guidelines pursuant to section 15301 Class 1 (a) "Interior or exterior <br />alterations to existing structures," because the proposed project consists of tenant <br />improvements to an existing commercial space. <br /> <br />CONDITIONS OF APPROVAL: It is the responsibility of the property owner, project applicant, <br />tenant, and/or any other party identified in this document to adhere to and perform the following <br />conditions of approvals in the time specified. If no time is specified then the condition is <br />considered to be an ongoing obligation. <br /> <br />1. The subject use shall substantially conform to the revised plans and related information <br />submitted by Nils Helppi and date stamped April 17, 2009, on file with the Planning <br />Services, except as modified by the conditions contained herein. <br /> <br />2. Any minor modifications to said approved plans, elevations and use must be submitted <br />to Planning Services for review and approval prior to the issuance of a building permit <br />and construction of improvements. Substantial modifications, as determined by <br />Planning staff, may require an amendment to this Use Permit. <br /> <br />3. This Use Permit is issued to Ning Yang & RongRong Guang and is not transferable to <br />another person(s) or entity. <br /> <br />4. In the event that any illegal activities take place at this business as determined by the <br />City, this Use Permit may be revoked pending notice by the Planning Division pursuant <br />to Article 42.8, subsection B. <br /> <br />5. The proposed business shall be limited to a maximum of four (4) private therapy rooms. <br /> <br />6. No more than five (5) technicians shall be on premises at any given times, out of which <br />only four (4) technicians can be providing massage therapy. <br /> <br />Page 3 of 5 <br />
