8.C. - Page 49 of 49 <br />• Move the Home Occupation regulations from the Definitions section to Article 31 <br />(Special Uses) and include minor changes. <br />Accessory Outdoor Uses <br />• Accessory Outdoor Uses: Add new section to allow accessory outdoor uses in <br />commercial and mixed-use zoning districts. <br />Anal <br />The question is whether the proposed amendments could have a significant impact on the <br />environment, within established CEQA thresholds. CEQA significance is separate from the <br />discussion of policy significance. There may be items that have policy consequences but can <br />be seen, with certainty, not to have an effect on the environment as evaluated by CEQA. <br />Topics evaluated by CEQA include: Aesthetics, Agricultural and Forestry Resources, Air <br />Quality, and Greenhouse Gas Emissions, Biological, Cultural and Mineral Resources, Geology, <br />Hazards and Hazardous Materials, Hydrology and Water Quality, Land Use and Planning, <br />Noise, Population and Housing, Public Services and Recreation, Transportation and Traffic, <br />and Utilities and Service Systems. <br />Section 15061(b)(c) states that when it can be seen with certainty that the project will not <br />have a significant effect on the environment, the activity is not subject to CEQA because of <br />this "common sense exemption." The following can be seen with certainty not to have an <br />impact on the environment as described in the above topics, because the project is limited <br />to: <br />• Rewording, reorganizing and clarifying terms <br />• Changing valid permit durations for planning entitlements <br />• Updating definitions allowing for low -barrier navigation centers, detached <br />residential dwellings, open space in the front yard, and increased flexibility on front <br />yard determination. <br />• Removing PD permit requirement from projects that require review through <br />Architectural Permits or Condominium Permits. <br />• Minor changes to regulations governing nonconforming structures and uses. <br />• Adding new provisions allowing accessory outdoor uses to retail, restaurant, and <br />commercial service uses that are minor in nature. <br />Page 2 of 2 <br />481 <br />
