The general permit is in compliance with the federal <br />Clean Water Act and the National Pollutant Discharge Elimination System (NPDES) permit <br />process. The state's general permit authorizes the discharge of storm water to surface waters <br />from construction activities that result in the disturbance of one or more acres of land, provided <br />that the discharger satisfies all permit conditions. <br /> <br />The penalty for non-compliance of the provisions of this general permit will have a significant <br />effect on cities because cities regulate discharge and discharge waste water in their operations. <br /> <br />A key provision in the adopted permit is the establishment of a numeric effluent limit (NEL). The <br />NEL applies to the runoff of both public and private construction projects. SWRCB staff performed <br />various tests to determine an appropriate limit of 500 nephelometric turbidity units (NTU). <br />SWRCB estimates that the cost of compliance will be approximately $1,000 per construction site <br />for the entire project. <br /> <br />The permit provisions go into effect on July 1,2010. After this date, construction projects that <br />exceed the 500 NTU may face penalties under the state's mandatory minimum penalty statute. <br /> <br />8 <br />
