6.M. - Page 2 of 22 Environmental Quality Act and also amended the definition of "Homeless shelter' to include a "parking lot owned or leased by a city, county, or city and county specifically identified as one allowed for safe parking by homeless and unstably housed individuals". The City championed this Bill, and the Bill's author, Assembly Member Phil Ting, worked with City staff and the City's legislative consultant to include specific language the City requested and an urgency clause in order to quickly establish the City's safe parking facility upon the Governor signature. Approved and signed as an urgency statute, AB 2553 paved the way for the City to operate a safe parking program 24 hours per day/seven days per week. The off-street Temporary RV Safe Parking Site located at 1402 Maple Street opened for program participants on October 20, 2020 with a total of 40 designated parking spaces for RV residents. The site currently houses 40 RV households including 17 households with minor children and 15 households with adults over age 60 or a member with a disability. LifeMoves is the contracted Safe Parking Site Program Operator and provider of Community Outreach Case Management Services to assist RV residents in transitioning to permanent housing and in obtaining needed social and/or employment services to support their transition to permanent housing. ANALYSIS In accordance with Government Code section 8698.4(a)(2)(A)(i), a city, in lieu of compliance with local building approval procedures or state housing, health, habitability, planning and zoning, or safety standards, procedures and laws, may adopt by ordinance reasonable local standards and procedures for the design, site development, and operation of homeless shelters and the structures and facilities therein, to the extent that strict compliance with state and local standards or laws would in any way prevent, hinder, or delay the mitigation of the effects of the shelter crisis. The proposed ordinance addresses reasonable local standards in that the City is not utilizing or providing any existing residential or nonresidential buildings or structures for emergency housing as part of any emergency shelter offered through the Safe Parking Program. Additionally, the City is not providing RVs as part of the Temporary RV Safe Parking Program. The RVs participating in the program are stand-alone units owned by the program participants and not within the City's control. The City does offer program participants the opportunity to park their RVs, on a temporary basis, at the off-street Safe Parking Site during a period that the City has declared a shelter crisis. The City has established standards, identified in the ordinance, that protect health and safety for the operation of the Safe Parking Site and which address the condition of the RV by requiring among other things, that the RV be in an operable condition.
