The City has established standards, <br />identified herein, that protect health and safety for the operation of the <br />Temporary Safe Parking Program, including among other things, standards <br />that require that the RVs used by Program Participants in the Temporary Safe <br />Parking Program are operable. Additionally, the standards require that <br />administrative staff for the Temporary Safe Parking Program be present 24/7 <br />to address any issues or problems that may arise at the Parking Site. <br />2) Minimum Standards in Appendix O, Section 0104/Appendix X, Section <br />AX104: <br />The Subsections in these Sections provide minimum standards relating to <br />"Emergency Sleeping Cabins" which are defined as a "[r]elocatable hard -sided <br />structure constructed in accordance with this appendix, which may be occupied <br />only for emergency housing if allowed by the enforcing agency." <br />The City cannot meet the minimum standards relating to "Emergency Sleeping <br />Cabins" in Sections 0104/AX104 and its Subsections, because the City is not <br />utilizing or providing any relocatable hard -sided structure for emergency housing <br />as part of any emergency shelter offered through the Temporary Safe Parking <br />Program. The City is also not providing the RVs as part of the emergency shelter <br />offered through the Temporary Safe Parking Program. The RVs participating in the <br />Temporary Safe Parking Program are stand-alone units. The RVs are owned by <br />the Program Participants and not within the City's control and therefore the City <br />cannot confirm that the RVs meet the minimum standards in these Sections and <br />Subsections. <br />3) Minimum Standards in Appendix O, Section 0105/Appendix X, Section <br />AX105: <br />The Subsections in these Sections provide minimum standards relating to <br />"Emergency Transportable Housing Units" which are defined as "single- or <br />multiple -section prefabricated structure that is transportable by a vehicle and that <br />can be installed on a permanent or temporary site in response to a need for <br />emergency housing. Emergency transportable housing units include, but are not <br />limited to, manufactured homes, mobile -homes, multifamily manufactured homes, <br />recreational vehicles, and park trailers. For the purposes of this appendix, <br />emergency transportable housing units may also include commercial modulars as <br />defined in the Health and Safety Code Section 18001.8, if approved by the <br />enforcing agency. Emergency transportable housing units do not include factory - <br />built housing as defined in the Health and Safety Code Section 19971." <br />The City cannot meet the minimum standards relating to "Emergency <br />Transportable Housing Units in Sections 0105/AX105 and its Subsections <br />because the City is not utilizing or providing single or multiple section prefabricated <br />structures that are transportable by a vehicle and that can be installed on a <br />permanent or temporary site for emergency housing as part of any emergency <br />shelter offered through the Temporary Safe Parking Program.
