6.M. - Page 12 of 22 providing any manufactured homes, mobile homes, multifamily manufactured homes, commercial modulars, RVs, or park trailers to the Program Participants for emergency housing as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by the Program Participants and not within the City's control and therefore the City cannot ensure that the RVs participating in the Temporary Safe Parking Program meet the minimal standards relating to emergency transportable housing units in these Sections and Subsections. 4) Minimum Standards in Appendix O, Section 0106/Appendix X, Section AX106: The Subsections in these Sections provide minimum standards relating to "Tents and Membrane Structures." A tent is defined as "[a] structure, enclosure or shelter, with or without sidewalls or drops, constructed of fabric or pliable material supported by any manner except by air or the contents that it protects." A membrane structure is defined as "[a]n air -inflated, air -supported, cable or frame - covered structure, not otherwise defined as a tent..." The City cannot meet the minimum standards relating to "Tents and Membrane Structures" in Sections 0106/AX106 and its Subsections because the City is not utilizing or providing any structure, enclosure or shelter constructed of fabric or pliable material for emergency housing as part of any emergency shelter offered through the Temporary Safe Parking Program. The City is also not utilizing or providing any air -inflated, air -supported, cable or frame -covered structure as part of any emergency shelter offered through the Temporary Safe Parking Program. The Temporary Safe Parking Program only allows RVs owned by Program Participants to park on the Parking Site, therefore tents and membrane structures will not be utilized on the Parking Site by the Program Participants. 5) Minimum Standards in Appendix O, Section 0107/Appendix X, Section AX107: These Sections provide minimum standards relating to "Accessibility" and provide that "[e]mergency housing shall comply with the applicable requirements in the California Building Code, Chapter 11 B and/or the US Access Board Final Guidelines for Emergency Transportable Housing. [Note Omitted]" The City cannot meet the minimum standards relating to "Accessibility" in Sections 0107/AX107 because the City is not utilizing or providing any permanent or temporary emergency housing or emergency transportable housing as any part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by the Program Participants and not within the City's control and therefore, the City cannot ensure that the RVs meet the minimal accessibility standards in these Sections.
