6.M. - Page 12 of 22 <br />providing any manufactured homes, mobile homes, multifamily manufactured <br />homes, commercial modulars, RVs, or park trailers to the Program Participants for <br />emergency housing as part of the emergency shelter offered through the <br />Temporary Safe Parking Program. The RVs participating in the Temporary Safe <br />Parking Program are stand-alone units. The RVs are owned by the Program <br />Participants and not within the City's control and therefore the City cannot ensure <br />that the RVs participating in the Temporary Safe Parking Program meet the <br />minimal standards relating to emergency transportable housing units in these <br />Sections and Subsections. <br />4) Minimum Standards in Appendix O, Section 0106/Appendix X, Section <br />AX106: <br />The Subsections in these Sections provide minimum standards relating to "Tents <br />and Membrane Structures." A tent is defined as "[a] structure, enclosure or shelter, <br />with or without sidewalls or drops, constructed of fabric or pliable material <br />supported by any manner except by air or the contents that it protects." A <br />membrane structure is defined as "[a]n air -inflated, air -supported, cable or frame - <br />covered structure, not otherwise defined as a tent..." <br />The City cannot meet the minimum standards relating to "Tents and Membrane <br />Structures" in Sections 0106/AX106 and its Subsections because the City is not <br />utilizing or providing any structure, enclosure or shelter constructed of fabric or <br />pliable material for emergency housing as part of any emergency shelter offered <br />through the Temporary Safe Parking Program. The City is also not utilizing or <br />providing any air -inflated, air -supported, cable or frame -covered structure as part <br />of any emergency shelter offered through the Temporary Safe Parking Program. <br />The Temporary Safe Parking Program only allows RVs owned by Program <br />Participants to park on the Parking Site, therefore tents and membrane structures <br />will not be utilized on the Parking Site by the Program Participants. <br />5) Minimum Standards in Appendix O, Section 0107/Appendix X, Section <br />AX107: <br />These Sections provide minimum standards relating to "Accessibility" and provide <br />that "[e]mergency housing shall comply with the applicable requirements in the <br />California Building Code, Chapter 11 B and/or the US Access Board Final <br />Guidelines for Emergency Transportable Housing. [Note Omitted]" <br />The City cannot meet the minimum standards relating to "Accessibility" in Sections <br />0107/AX107 because the City is not utilizing or providing any permanent or <br />temporary emergency housing or emergency transportable housing as any part of <br />the emergency shelter offered through the Temporary Safe Parking Program. The <br />RVs participating in the Temporary Safe Parking Program are stand-alone units. <br />The RVs are owned by the Program Participants and not within the City's control <br />and therefore, the City cannot ensure that the RVs meet the minimal accessibility <br />standards in these Sections. <br />ATTY/ORD.533/CC ORD SAFE PARKING PROGRAM <br />REV: 04-06-21 RL <br />Page 8 of 18 <br />366 <br />
