6.M. - Page 13 of 22 <br />Notwithstanding the foregoing, the City can meet certain accessibility standards as <br />they may apply to the Parking Site and other amenities offered as part of the <br />Temporary Safe Parking Program, such as accessible temporary toilets offered in <br />the common areas of the Parking Site. The City is evaluating and identifying <br />accessibility issues as it progresses towards compliance with the minimum <br />standards in Sections 0107/AX107 that pertain to the Parking Site. <br />6) Minimum Standards in Appendix O, Section 0108/Appendix X, Section <br />AX108: <br />These Sections provide minimum standards relating to "Lofts in Emergency <br />Housing." A loft is defined as "[a] floor level located more than 30 inches (762 mm) <br />above the main floor and open to it on at least one side with a ceiling height of less <br />than 6 feet 8 inches (2032 mm), used as a living or sleeping space." <br />The City cannot meet the minimum standards relating to "Lofts in Emergency <br />Housing" in Sections 0108/AX108 and its Subsections because the City is not <br />utilizing or providing any buildings or structures, either with or without a loft, for <br />emergency housing as part of any emergency shelter offered through the <br />Temporary Safe Parking Program. Additionally, the RVs participating in the <br />Temporary Safe Parking Program are stand-alone units. The RVs are owned by <br />the Program Participants and not within the City's control and therefore the City <br />cannot ensure that the RVs participating in the Temporary Safe Parking Program <br />meet the minimal standards relating to lofts, to the extent they would apply to RVs, <br />in these Sections and Subsections. <br />7) Minimum Standards in Appendix O, Section 0109/Appendix X, Section <br />AX109: <br />The Subsections in these Sections provide minimum standards relating to location, <br />maintenance and identification. <br />a. Minimum Standards in Subsections 0109.1/AX109.1 ("Maintenance") <br />states "[e]mergency housing and emergency housing facilities shall be <br />maintained in a safe and sanitary condition, and free from vermin, vectors and <br />other matter of an infectious or contagious nature. The grounds within <br />emergency housing sites shall be kept clean and free from accumulation of <br />debris, filth, garbage and deleterious matter. Emergency housing and <br />emergency housing facilities shall not be occupied if a substandard condition <br />exists, as determined by the enforcing agency. " <br />The City cannot meet the foregoing "Maintenance" minimum standards <br />because the City is not utilizing any permanent or temporary emergency <br />housing or emergency housing facilities as part of any emergency shelter <br />offered through the Temporary Safe Parking Program. The RVs participating <br />in the Temporary Safe Parking Program are stand-alone units. The RVs are <br />privately owned and not within the City's control.
