6.M. - Page 15 of 22 Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by the Program Participants and not within the City's control. As such, the City cannot require that the RVs be identified in any permanent manner. Notwithstanding the foregoing, the City has established standards, identified herein, that protect health and safety for the operation of the Temporary Safe Parking Program and address identification. The standards require, among other things, that RVs parking on the Parking Site be assigned a specific parking space to ensure adequate identification. The RVs are placed in various locations at the Parking Site and cannot all be parked in a manner facing the street. 8) Minimum Standards in Appendix O, Section 0110/Appendix X, Section AX110: The Subsections in these Sections provide minimum standards relating to "Emergency Housing Facilities," which are defined as "[o]n-site common use facilities supporting emergency housing. Emergency housing facilities include, but are not limited to, kitchen areas, toilets, showers and bathrooms with running water. The use of emergency housing facilities is limited exclusively to the occupants of the emergency housing, personnel involved in operating the housing, and other emergency personnel." a. Minimum Standards in Subsections 0110.2/AX110.2 ("Kitchens") states "[w]here occupants of dependent units are permitted or required to cook for themselves, a separate area shall be equipped and maintained as a common use kitchen. Refrigerated storage shall be provided for safe storage of food." The City cannot meet the foregoing "Kitchen" minimum standards because the City is not is not utilizing or providing any emergency housing or emergency housing facilities as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by the Program Participants and not within the City's control. As such, the City cannot ensure that kitchens that are in an RV meet the minimum standards in these Subsections. Notwithstanding the foregoing, the Temporary Safe Parking Program does offer participants in the Temporary Safe Parking Program a parking space upon which they may park their RV on a temporary basis during a period that the City has declared a shelter crisis. The Temporary Safe Parking Program is only available to RVs, which may contain certain kitchen facilities, within which Program Participants may cook for themselves. b. Minimum Standards in Subsections 01 10.3/AX1 10.3 ("Toilet and Bathing Facilities") states "[w]hen dependent units are used as emergency housing, the emergency housing site shall be provided with one toilet and one bathing facility ATTY/ORD.533/CC ORD SAFE PARKING PROGRAM REV: 04-06-21 RL Page 11 of 18 369
