The approval shall be based upon a finding that the type and ratio of toilet and bathing facilities are sufficient to process the anticipated volume of sewage and waste water, while maintaining sanitary conditions for the occupants of the emergency housing. Bathing facilities shall be provided with heating equipment which shall be capable of maintaining a temperature of 70 degrees F (21.0 degrees Celsius) within such facilities. Lavatories with running water shall be installed and maintained in the toilet facilities or adjacent to the toilet facilities." The City cannot meet the foregoing "Toilet and Bathing Facilities" minimum standards because the City is not utilizing or providing any emergency housing or emergency housing facilities as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by the Program Participants and not within the City's control. As such, the City cannot ensure that the toilets and bathing facilities in the RVs meet the minimum standards in these Subsections. Notwithstanding the foregoing, the Temporary Safe Parking Program does offer participants in the Temporary Safe Parking Program a parking space upon which they may park their RV on a temporary basis during a period that the City has declared a shelter crisis. The Temporary Safe Parking Program is only available to RVs, which may contain certain toilet facilities. Additionally, the City has established standards, identified herein, that protect health and safety for the operation of the Temporary Safe Parking Program and address common area toilet facilities. The standards require, among other things, that common use temporary toilets and hand washing stations at the Parking Site will be available as part of the Temporary Safe Parking Program. The standards also require that Program Participants use a proper dumping facility for all disposal of stored sewage waste and are provided vouchers for proper disposal. These types of temporary facilities and ratio of toilets are sufficient to process the anticipated volume of sewage and waste water, while maintaining sanitary conditions for the Temporary Safe Parking Program. C. As set forth above, the City cannot meet all of the minimum standards in Appendix O or Appendix X. Additionally, there may be other state and local requirements relating to emergency shelters or emergency housing that the City cannot comply with due to the specific type of temporary emergency shelter being offered through the Temporary Safe Parking Program. The reasonable local standards adopted in this ordinance for the operation of the Parking Site included in the Temporary Safe Parking Program provide safeguards to ensure that health and safety is protected.
