<br />88 <br />ATTACHMENT Page 12 <br /> <br />Findinas: <br />a. That pursuant to Zoning Ordinance Section 46.7, which sets forth <br />additional findings for granting any Planned Development Permit, the City <br />Council does not approve the creek setback modifications because the <br />project neither improves nor respects the natural character of the creek. <br />In order to truly optimize and respect the natural features of the site, this <br />project should abide by the 25 foot setback. Even though the code may <br />relate specifically to NPDES requirements) overall the intention of a <br />planned development permit modification is to provide a project that is <br />better than what would occur under standard subdivision regulations. An <br />exception should only be granted when a special feature of the project is <br />preserved, highlighted, or created by permitting a modification of existing <br />design standards. Modifications should make a project more compatible <br />with the neighborhood and not detract from the existing character. The <br />creek is an important feature of this neighborhood, and locating large <br />building structures near the creek does not respect or enhance its natural <br />character. <br /> <br />C. PRIVATE STREET DESIGN EXCEPTION - SPECIAL CONSIDERATION OF <br />PLANNED DEVELOPMENT PERMIT <br /> <br />1. Recommendation: That City Council deny the requested reduction in street <br />width from 25 ft. to 22 ft. for a one-way street and the inclusion of a 4 ft. wide <br />pedestrian walkway. That pursuant to Redwood City Municipal Code Section <br />30.118.8, the City Council finds that this exception to the street width <br />standards is not in the public interest. That pursuant to Redwood City <br />Municipal Code 30.69, the City Council finds the following: <br /> <br />a. The property is not of such shape or size, or is affected by such <br />topographical conditions, or is subject to such title limitations of record that <br />it is impossible or impracticable for the subdivider to comply with the <br />requirement with which exception is taken. <br /> <br />By reducing the number of units within the project, the developer may <br />incorporate a two way street that would comply w;th the City's standard <br />street width requirements. <br /> <br />b. The exception is not necessary for the preservation and enjoyment of a <br />substantial property right of the subdivider. <br /> <br />The City Council determines that a one-way street does not best serve the <br />development and the community because that street type is not superior <br />to other options for th is project: a two way street or cu I de sac. <br /> <br />2 <br />
