BAYSHORE – EXHIBIT A <br />REV: 05-12-23 JB <br />Page 20 of 30 <br />implemented for the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact BIO-6. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measures BIO-6.1 and BIO-6.2 into the <br />Project would substantially lessen the severity of Impact BIO-6, such that this potential <br />impact would be less than significant, because these measures will require the <br />prohibition of outdoor cats and off-leash dogs on the property following construction <br />and the implementation of a food waste management system so that predation on the <br />site is mitigated. This finding is based on the entire record of proceedings for the <br />Project, including but not limited to the discussion and analysis set forth on pages 46 <br />through 77 of the DEIR, which includes a full statement of the impact and applicable <br />mitigation measures and is hereby incorporated herein in its entirety. <br /> <br />7.Biological Resources Impact BIO-C: The project would not result in a cumulatively <br />considerable contribution to a cumulatively significant biological resources impact. <br /> <br />Mitigation Measures. with the implementation of mitigation measures MM <br />BIO 1.1 through MM BIO-1.13, and BIO-2, BIO-3, and BIO-4 as provided in the <br />MMRP. <br /> <br />Findings Regarding Impact BIO-C: The City Council herby finds that <br />incorporating the requirements of Mitigation Measures MM BIO 1.1 through MM BIO- <br />1.13, and BIO-2, BIO-3, and BIO-4 into the project would substantially lessen the <br />severity of Impact BIO -C, such that this potential impact would be less than significant <br />cause these measures will require will require pre-activity and pre-disturbance surveys, <br />avoidance/non-disturbance buffers, shielding/ orientation and minimization of lighting <br />to bird nesting and other wildlife. Mitigation also includes worker environmental <br />awareness programs. Bird-safe building design implementation is required to reduce <br />bird collisions. Further mitigations include environmentally sensitive area fencing, <br />immediate work stoppage, and integrated invasive weed management program, <br />prohibition of outdoor cats and off-leash dogs and food waste management <br />Additionally, the measures will require implementation of invasive weed best <br />management practices that include restriction of invasive planting, equipment washing, <br />and erosional control seed mix planting as specified. This finding is based on the entire <br />record of proceedings for the Project, including but not limited to the discussion and <br />analysis set forth on pages 46 through 77 of the DEIR, which includes a full statement <br />of the impact and applicable mitigation measures and is hereby incorporated herein in <br />its entirety. <br /> <br /> <br />1. Hazards and Hazardous Materials Impact HAZ-1: The project could expose <br />construction workers to hazardous materials associated with contaminated fill on the <br />site. <br /> <br />Mitigation Measures. Mitigation Measure HAZ-1.1 will be implemented for <br />the Project as provided in the MMRP.
