REV: 06-22-2023 JB <br />3. The Caltrans Construction Cooperative Agreement must be executed, and the Construction <br />Management Team must be formed and launched; and <br />4. Caltrans’ processes leading up to the contract award must be completed. <br />A.4.1 Utility and Right of Way Certification <br />Consultant will oversee, manage and support the Design Consultant (AECOM) and Right of Way (R/W) <br />Consultant (AR/WS) in the work of appraisals, acquisitions, condemnations, interim property <br />management, utility relocations, and ultimately Right of Way Certification. Consultant will coordinate to <br />efficiently address the needs and concerns of stakeholders. Consultant will work closely with Caltrans <br />within the limits of the cooperative agreement for the Right of Way phase. <br />Consultant will ensure completion of all of the utility and R/W work scopes which include, but may not <br />be limited to: <br />1. Compile a thorough understanding of the parcel status, including history of previous decisions and <br />discussions with key stakeholders. <br />2.Conduct regular and focused Right of Way meetings with appropriate stakeholders throughout the <br />Right of Way Phase. <br />3.Update Right of Way Appraisal Maps and Tables, create and/or update internal tracking documents. <br />4.Make necessary submittals to Caltrans District and Headquarters Right of Way and Land Surveys <br />units to obtain Right of Way Certification. <br />5.Develop strategies to guide various project Right of Way issues to resolution, including outreach and <br />coordination with landowners and project stakeholders to address challenges arising from full or <br />partial parcel acquisition. <br />6.Continually assess and categorize risks associated with the Right of Way Phase. <br />7.Provide technical oversight and support to ensure project deliverables meet Caltrans project <br />delivery requirements regarding agreements, certifications, approvals, and being Ready to List for <br />construction. <br />8. Make sure all utility relocations are coordinated with and approved by the utility companies with <br />support from the Design Consultant to achieve Right of Way certification. <br />Consultant will monitor the Right of Way Phase progress to inform the overall Project schedule and <br />ensure the Project delivery is proceeding according to the schedule. <br />A.4.2 UPRR Coordination <br />Consultant will organize a meeting with appropriate UPRR team staff prior to all project submittals to <br />ensure timely review of key issues. <br />Early Evaluation of Design Exceptions & Variances: Consultant will review and vet proposed <br />alternatives as needed to ensure any required or beneficial requests for variances are identified and <br />negotiated early with UPRR. <br />Railroad Agreements & Pre-Construction: Consultant will advise the City on typical railroad <br />agreement requirements, review and negotiate UPRR agreement(s) for construction scope and <br />costs. <br />ATTY/AGR.2023.120/Gray-Bowen-Scott (101-84 Project Delivery) (Page 15 of 24)
