<br />Intent to Convert is not received by the Redwood City Planning Division within the 30 day period, the Applicant will have waived the right to this conversion. If no additional MAD Cap office space becomes available within the aforementioned two year window, this conditions shall no longer apply. C. In accordance with Section 2.0.4 of the Downtown Precise Plan, a project shall be deemed to be entitled to the square footage upon issuance of a Building Permit. Pursuant to Section 52.13 of the Zoning Ordinance, in the event that a building permit has not been issued for the project within one (1) year of the date of final DPC2014-04 approval, the project approvals shall expire.
<br />100. Ground Floor Retail – Except as provided in Condition No. 99 above, the applicant is required to maintain a ground floor square footage of 13,515 square feet of retail, community center uses, or other active store front uses as allowed under the Downtown Precise Plan, for the life of the building (a maximum of 2,600 square feet that does not front onto Broadway Street or Jefferson Avenue may be converted to office use). However, the Broadway facing tenant space(s) must remain “traditional” retail uses (with a depth of at 35’ or more), such as a general retail, coffee shop, food service restaurant, etc. Financial services shall be limited to 3,800 square feet. Substantial Conformity – Applicant shall ensure that all improvements substantially conform to the project plans prepared by KSH Architects, dated received December 10, 2015, and revised on February 20, 2020 to allow for a 3,800 square foot financial service use at the corner of Broadway and Jefferson Avenue, as well as any design modifications required through the final project approval including conditions of approval contained herein, and related information submitted by the Applicant, on file with Planning Services. <br />102. Exterior Materials – The exterior materials, colors, textures, trim elements, windows and roof pitch of the project shall be consistent throughout and substantially conform to the colors and plans, date received December 10, 2015, on file with Planning Services. [COA][PLANNING]
<br />103. Revisions – All modifications to the approved plans shall be submitted to Planning and Engineering for review and approval prior to the issuance of a Building Permit. Substantial modification of approved plans, as determined by the Zoning Administrator, may be subject to an amendment or a new Permit. Permit revisions shall follow the “Revisions” procedure in the Engineering Standards. [COA][PLANNING][ENGINEERING]
<br />104. Indemnification – Per Redwood City Municipal Code Section 1.54, Applicant shall defend (with counsel approved by City), indemnify, and hold harmless the City, its agents, officers, and employees from and against any claim, action, or proceeding (including without limitation any appeal or petition for review thereof) against the City or its agents, officers or employees, to attack, set aside, void, or annul an approval of the Project, including without limitation any related application, permit, certification, condition, environmental determination, other approval, compliance or failure to comply with applicable laws and regulations, and/or processing methods (“Challenge”). City may (but is not obligated to) defend such Challenge as City, in its sole discretion, determines appropriate, all at applicant’s sole cost and expense.
