The Final EIR has been completed in compliance with CEQA (Public Resources <br />Code Section 21000 et seq.) and the CEQA Guidelines (Title 14, Section 15000 <br />et seq., of the California Code of Regulations) and the applicable provisions of <br />the Redwood City Municipal Code. <br />c. The Final EIR has been reviewed and considered by the Planning Commission <br />prior to the Council’s rendering of any decision regarding the approval of the <br />Project entitlements. <br />d. The Final EIR reflects the City’s independent judgment and has been found by <br />the City to be adequate to support the City’s approval of the Project entitlements. <br />e. The information added in the Final EIR does not constitute new significant <br />information requiring recirculation. <br />f. Based on the City’s review of the Final EIR, it has been determined that the <br />Project may have significant and unavoidable effects on the environment, but the <br />benefits of implementation of the Project outweigh those impacts as described <br />in the Findings and Statements Required by the California Environmental Quality <br />Act and Statement of Overriding Considerations described in section (h) below. <br />g. Pursuant to Section 15091 of the CEQA Guidelines, the City’s actions with <br />respect to the Project shall be based upon and subject to the findings, <br />conclusions, mitigation measures and statements set forth in the Findings and <br />Statements Required by the California Environmental Quality Act and Statement <br />of Overriding Considerations attached hereto as Exhibit A and incorporated <br />herein by reference. <br />h. Specific economic, legal, social, technological, or other benefits outweigh the <br />unavoidable adverse environmental effects identified in the Final EIR. <br />i. Pursuant to Section 15091 of the CEQA Guidelines, any subsequent actions or <br />approvals to implement the Project shall be based upon and subject to the <br />findings, conclusions, mitigation measures and statements set forth in the <br />Findings and Statements Required by the California Environmental Quality Act <br />and Statement of Overriding Considerations attached hereto as Exhibit A. <br /> <br />Section 3. 1304 El Camino Real CEQA Analysis. In the exercise of its independent <br />judgment, the Planning Commission finds that: <br />a. The 1304 El Camino Real (“project Parcel F”) CEQA Analysis was prepared in <br />accordance with all legal requirements. <br />b. The Planning Commission has reviewed and analyzed the 1304 El Camino Real <br />CEQA Analysis and other information in the entire record and has considered <br />the information contained therein, including the written and oral comments <br />received at the public hearing on the Project, prior to acting upon or approving <br />the Project. <br />c. Based on substantial evidence in the record, the project Parcel F is within the <br />scope of the previously approved Downtown Precise Plan and is adequately <br />described in the previously certified Downtown Precise Plan Program EIR for <br />purposes of CEQA. The mitigation measures and Statement of Overriding <br />Considerations associated with certification of the Program EIR address the <br />environmental effects of the Project.
