Downtown Planned Community Permit Findings. In the exercise of its <br />independent judgement, the Commission finds that: <br /> <br />a. The project and improvements proposed under Downtown Planned Community <br />Permit Application No. DPC2019-02 at 1304 El Camino Real are consistent with, <br />conform to the intent of, and will appropriately implement the Downtown Precise Plan; <br /> <br />b. The establishment, maintenance and operation of the project and improvements <br />proposed under Downtown Planned Community Permit No. DPC2019-02 will not, <br />under the circumstances of this particular case, be detrimental to the health, safety, <br />peace, morals, or general welfare of persons residing or working in the neighborhood <br />of the project, or be detrimental or injurious to property or improvements in the <br />neighborhood of the project, or to the general welfare of the City, because the project <br />has been found to be consistent with the community goals established in the City’s <br />General Plan and Zoning Ordinance; <br /> <br />c. The Project and improvements comply fully with all applicable standards of the DTPP, <br />with the exception of the concessions and waivers to the parking and side yard <br />setback and with the maximum building height, in accordance to state density bonus <br />law; <br /> <br />d. The Project and improvements proposed under Downtown Planned Community <br />Permit Application No. DPC2019-02 will not create a significant adverse impact the <br />historic landmark located adjacent to the project site located at 1322 El Camino Real <br />(Record Man; DTPP Historic Resource R); will retain their eligibility for listing on the <br />California Register of Historic Places as detailed in HRAC Resolution No. 20-01; <br /> <br />e. The Project and improvements comply with all but two guidelines of the DTPP <br />pertaining to the building disposition type and window glazing. In accordance to the <br />DTPP, these requested guideline deviations were considered by the Architectural <br />Advisory Committee and found to be acceptable as designed. The project, <br />including the two requested guideline deviations, would appropriately implement the <br />goals, vision and intent of the DTPP. <br /> <br />Section 4. Planned Development Permit Findings. The proposed Project includes <br />office, retail, residential and child care space and publicly-accessible open space. Offsite <br />improvements and other implementation measures are included in the project are consistent with <br />the requirements of the Mixed Use Corridor – El Camino Real and Mixed-Use Transitional zoning <br />districts. The Commission finds that approval of a Planned Development Permit is appropriate <br />for the proposed Project, as follows: <br /> <br />a. Permit Finding. The design and construction quality contained in all aspects of the <br />development plan is expected to exceed the quality standards typically required for <br />new developments located in similar zoning districts.
