Findings and Statements Required by the California Environmental Quality Act <br />Redwood City Transit District DTPP Amendments 38 ESA / 202100421.00 <br />Subsequent Environmental Impact Report October 2022 <br />previously identified in the DTPP Final EIR. The City Council hereby finds, however, that <br />there are specific economic, environmental, social, legal, technological and other <br />considerations that make infeasible the potential mitigation measures described in the SEIR <br />to mitigate the effect of Impact C-AQ-1, and that development of the Project will provide <br />specific economic, environmental, social, legal, technological and other benefits that will <br />outweigh the significant adverse effects of Impact C-AQ-1, as set forth in the Statement of <br />Overriding Considerations below. This finding is based on the entire record of proceedings <br />for the Project, including but not limited to the discussion and analysis set forth on pages <br />17-23 to 17-24 of the DSEIR, which includes a full statement of the impact and is hereby <br />incorporated herein in its entirety. <br />Impact C-AQ-2: Adoption of the proposed Transit District DTPP Amendments, in <br />combination with past, present, existing, approved, pending, and reasonably foreseeable <br />future projects, would not result in a cumulatively considerable contribution to local health <br />risk impacts. <br />Mitigation Measures. SEIR Mitigation Measure AQ-3 (FSEIR, p. 17-25) will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact C-AQ-3: Based on the FSEIR and the entire record before <br />the City, the Council finds that Mitigation Measure AQ-3 would substantially lessen the <br />severity of Impact AQ-3, such that this potential impact would be less than significant. <br />Mitigation Measure AQ-3 would require subsequent projects within 1,000 feet of existing <br />or approved sensitive receptors to undergo a project-level HRA at the time the project is <br />proposed and to utilize the clean construction equipment required by Mitigation Measure <br />AQ-2b if the project-specific health risk thresholds are exceeded. Therefore, the <br />contribution of the proposed Transit District DTPP Amendments to the cumulative health <br />risk would not be considerable and would not result in new or more severe cumulative <br />impacts than the impact identified in the DTPP Final EIR. <br />Impact C-CC-1: Implementation of the proposed Transit District DTPP Amendments, in <br />combination with past, present, existing, approved, pending, and reasonably foreseeable <br />future projects, would not result in a cumulatively considerable contribution to GHG <br />emissions that may have a significant impact on the environment or conflict with applicable <br />plans, policies or regulations adopted for the purpose of reducing the emissions of greenhouse <br />gases. <br />Mitigation Measures. SEIR Mitigation Measure CC-1 (FSEIR, p. 17-27) will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact C-CC-1: Based on the FSEIR and the entire record before <br />the City, the Council finds that Mitigation Measure CC-1 would substantially lessen the <br />severity of Impact C-CC-1. However, as explained under Impact CC-1, above, because <br />the Redwood City Reach Codes are less than two years old, and are, as such, a recently <br />adopted statement of City policy, full implementation of Mitigation Measure CC-1 may <br />not be feasible.
