Findings and Statements Required by the California Environmental Quality Act <br />Harbor View Project PAGE 7 OF 48 ESA / 170951 <br />Final Environmental Impact Report October 2022 <br />ATTY/RESO.0085/PC RESO RECOMMENDING CEQA – EXHIBIT A <br />REV: 11-02-2022 VR <br />Impact AIR-5: The Project would result in emissions of criteria air pollutants, but not at levels <br />that could violate an air quality standard, or contribute to an existing or projected air quality <br />violation. <br />Findings Regarding Impact AIR-5: Estimated operational criteria pollutant emissions <br />reported in the DEIR would not exceed the thresholds, and the reduced development of the Revised <br />Project would further reduce the emissions generated (DEIR Table 4.2-6 and FEIR Table 5-2.) <br />Therefore, this impact would be less than significant. (DEIR, pp. 4.2-26 to 4.2-27; FEIR, p. 2-11.) <br />Impact AIR-6: The Project operations would generate toxic air contaminants (TACs), <br />including diesel particulate matter, and carbon monoxide exposure, but would not expose <br />sensitive receptors to substantial air pollutant concentrations. <br />Findings Regarding Impact AIR-6: A significant source of TACs would not occur with <br />the Revised Project given its estimated number of daily vehicle trips and the development’s <br />proposed use of natural gas (not diesel) fired generators, which emit only negligible levels of TACs, <br />and the number of traffic volumes at affected intersections in the vicinity. Moreover, the Revised <br />Project involves less development than analyzed in the Draft EIR. Therefore, this impact would be <br />less than significant. (DEIR, pp. 4.2-27 to 4-2-29.) <br />Impact AIR-7: The Project would not create objectionable odors that would affect a substantial <br />number of people. <br />Findings Regarding Impact AIR-7: The Revised Project would not create any new source <br />of objectionable odors. Therefore, operational odor impacts of the Project would be less than <br />significant. <br />4.3 Biological Resources <br />Impact BIO-1.CU: The Project, combined with cumulative development in the Project <br />vicinity, would not result in significant cumulative impacts on special-status species, sensitive <br />habitats, wildlife movement corridors, wetlands, and other waters of the U.S. <br />Findings Regarding Impact BIO-1.CU: The vicinity of the Revised Project site largely <br />includes areas that have previously been developed. Cumulative developments, particularly those <br />in proximity to water and natural resources, have been or will be adequately assessed for their <br />potential to result in significant environmental effects and would be required to implement adopted <br />mitigation measures to reduce such impacts. The Revised Project, as well as other future projects <br />would be required to comply with local, state, and federal laws and policies and all applicable <br />permitting requirements of the regulatory and oversight agencies intended to address potential <br />impacts on biological resources. Therefore, this impact would be less than significant. (DEIR, pp. <br />4.3-35 to 4.3-36; FEIR, pp. 2-11 to 2-12.)
