Findings and Statements Required by the California Environmental Quality Act <br />Harbor View Project PAGE 6 OF 48 ESA / 170951 <br />Final Environmental Impact Report October 2022 <br />ATTY/RESO.0085/PC RESO RECOMMENDING CEQA – EXHIBIT A <br />REV: 11-02-2022 VR <br />open spaces are located approximately 0.5 miles in the Downtown planning area and in the <br />Southeast planning area. Nearby waterways range from approximately 700 and 1,200. Solar energy <br />collectors are also approximately 700 feet from the Project site. Overall, no continuous shadow <br />would be cast on these aforementioned facilities for a duration that would substantially impair their <br />use, if at all. Therefore, this impact would be less than significant. (DEIR, pp. 4-1.18 to 4.1-20; <br />FEIR, p. 2-11) <br />Impact AES-1.CU: The Project, in combination with cumulative development in the Project <br />vicinity and citywide, would not result in significant cumulative impacts to aesthetics. <br />Findings Regarding Impact AES-1.CU: Few cumulative developments that could <br />combine with the Revised Project to result in a cumulative adverse effect to scenic views/vistas, <br />character, lighting and glare, or shadow. Also, all cumulative projects in the city and vicinity of the <br />Revised Project site have or will be analyzed and, if necessary, mitigated for potential aesthetics <br />impacts, in addition to required compliance with standards and regulations in the General Plan, <br />Zoning Code, or applicable specific or precise plan. Therefore, this impact would be less than <br />significant. (DEIR, pp. 4.1-20 to 4.1-22; FEIR, p. 2-11.) <br />4.2 Air Quality <br />Impact AIR-2: Construction activities associated with the Project would generate toxic air <br />contaminants (TACs), including diesel particulate matter (DPM), but would not expose <br />sensitive receptors to substantial pollutant concentrations (Criterion d). (Less than Significant) <br />Findings Regarding Impact AIR-2: Sensitive receptors assessed under this impact were <br />the inmates of the Maple Street Correctional Center located near the Revised Project site. Maximum <br />cancer risk, the maximum chronic health risk index and the estimated PM2.5 concentrations were <br />all substantially below applicable thresholds. Therefore, this impact would be less than significant. <br />(DEIR, pp. 4.2-22 to 4.2-23; FEIR, p. 2-11) <br />Impact AIR-3: The Project would not create objectionable odors that would affect a substantial <br />number of people during construction <br />Findings Regarding Impact AIR-3: Construction-related odors of the Revised Project <br />would be temporary and would not persist upon Project completion. Therefore, this impact would be <br />less than significant. (DEIR, p. 4.2-22; FEIR, p. 2-11.) <br />Impact AIR-4: The Project would not conflict with, or obstruct implementation of the 2017 <br />Clean Air Plan <br />Findings Regarding Impact AIR-4: The Revised Project would not disrupt or hinder <br />implementation of control measures identified in the CAP because it includes several <br />characteristics that will help reduce single occupant vehicle trips generated — including those <br />identified as secondary mitigation measures to address significant traffic impacts, vehicle miles <br />travelled (VMT) and associated emissions. (Table 4.2-5 in the DEIR). Therefore, this impact would <br />be less than significant. (DEIR, pp. 4.2-23 to 4.2-26; FEIR, p. 2-11.)
