REV: 08-22-24 VR <br />Task 8 – California Environmental Quality Act (CEQA) Clearance <br />8a - Finalize CEQA Approach <br />DJP&A will develop a preferred CEQA approach and CEQA work plan/schedule following <br />the adoption of the framework plan in Task 6. To begin, DJP&A will review the framework <br />plan, confirm project understanding (including development assumptions), review prior <br />CEQA documentation prepared in the plan area (such as the DTPP EIR, Transit District <br />SEIR, and the DTPP Plan Wide Amendments Subsequent EIR), identify key <br />environmental issues, confirm necessary technical reports, collect necessary data and <br />research (including information completed in Task 4), and participate in a CEQA kickoff <br />meeting to confirm. The CEQA approach and work plan will account for the work <br />completed as part of Subtasks 3b, 3d, and 3e, so that this information can be used in <br />technical reports, where appropriate, prepared under Subtask 8b. <br />The EIR will tier from the certified 2010 DTPP Final EIR (State Clearinghouse <br />#2006052027), the certified Transit District SEIR, and the certified DTPP Plan-Wide <br />Amendments SEIR (State Clearinghouse # 2021090249)), as well as any other applicable <br />CEQA documents, to the maximum extent feasible depending on the contents of the <br />framework plan. The City’s current practice for DTPP projects is to prepare a consistency <br />initial study checklist to determine whether each proposal would result in any new <br />environmental effects not identified in the DTPP Final EIR or the SEIRs. It is anticipated <br />the EIR for this project will also be set up to allow streamlined environmental review for <br />future development projects by preparing Initial Study Checklists to the EIR. <br />DELIVERABLES: <br />CEQA kick off meeting; <br />draft and final CEQA approach and work plan. <br />8b - Draft and Final Environmental Impact Report (DEIR/FEIR) <br />DJP&A will develop environmental review documents as defined in Subtask 8a and <br />described below. <br />1.Prepare the Notice of Preparation: DJP&A will prepare a draft the EIR Notice of <br />Preparation (NOP) based on the adopted framework plan in Task 6 and submit it <br />electronically to the City to review for accuracy. The City will provideone round of <br />review and will provide DJP&A a single, consolidated set of comments. The NOP <br />will include a brief project description, project location map, and discussion of <br />potential environmental effects of the project. This scope includes one round of <br />review of the draft NOP by the City and that the City will provide a single, <br />consolidated set of comments in track changes. DJP&A will finalize the NOP based <br />on City comments. The City will send and file the NOP pursuant to CEQA. <br />2.Facilitate the Scoping Meeting: DJP&A will attend one public EIR scoping <br />meeting for the project and be available to describe the environmental review <br />ATTY/AGR.2024.139/Wallace Robers & Todd LLC (Downtown & Central RWC) (Page 48 of 60)
