<br />8 <br /> <br />management representatives, or to be present at hearings where matters within <br />the scope of representation or grievances are being considered. The use of <br />official time for this purpose shall be reasonable and shall not interfere with the <br />performance of City services as determined by the City Personnel Officer or the <br />Fire Chief. Such employee representatives shall submit a written request for <br />excused absence to the Fire Chief or designee with information copy to the City <br />Manager, at least two (2) working days prior to the scheduled meeting, unless <br />waived by the Fire Chief. Except by mutual agreement, the number of <br />employees excused for such purposes shall not exceed three (3). The Association <br />may provide one (1) steward for each shift. <br /> <br />SECTION 6 – NO STRIKE <br /> <br />The Association, its members and representatives, agree that it and they will not engage <br />in, authorize, sanction, or support any strike, slowdown, stoppage of work, curtailment <br />of production, concerted refusal of overtime work, refusal to operate designated <br />equipment (provided such equipment is safe and sound) or to perform customary duties; <br />and neither the Association, nor any representatives thereof, shall engage in job action <br />for the purpose of effecting changes in the directives or decisions of management of the <br />City, nor to effect a change of personnel or operations of management or of employees <br />not covered by this MOU. <br /> <br />SECTION 7 – PAY <br /> <br />7.1 Pay Period <br /> <br />Employees shall be paid bi-weekly. <br /> <br />All employees shall be subject to mandatory direct deposit. <br /> <br />7.2 Salaries <br /> <br />The City will conduct salary surveys annually to include factors traditionally <br />taken into consideration in the determination of wages, hours and other terms <br />and conditions of public and private employment including, but not limited to, <br />changes in the average Consumer Price Index for goods and services, the wages, <br />hours and other terms or conditions of employment of other employees <br />performing similar services, and the financial condition of the City. <br /> <br /> The following cities and districts are to be surveyed: Alameda, Berkeley, Daly <br />City, Menlo Park Fire Protection District, Mountain View, Palo Alto, Richmond, <br />Milpitas, San Mateo Consolidated Fire Department, San Ramon Valley Fire <br />Protection District, Santa Clara, and South San Francisco. These agencies shall <br />not be changed except by mutual consent of the parties. <br />6.A. - Page 19 of 99 <br />26
