<br />18 <br /> <br />responsibilities of the higher classifications. Acting Fire Marshal <br />assignments shall be for a minimum of one (1) calendar week. <br /> <br />7.10.2 Whenever a temporary vacancy occurs and it is determined by the <br />City that the position should be temporarily filled, an employee may <br />be assigned by the Fire Chief to work in the higher paid classification <br />at a rate of pay which is ten percent (10%) above the employee’s <br />adjusted hourly rate. Deputy Fire Marshals who agree to be assigned <br />to Acting Fire Marshal shall receive the bottom step of the Fire <br />Marshal salary or ten percent (10%) above the adjusted hourly rate, <br />whichever is higher. <br /> <br />7.10.3 After a position has been temporarily vacant for fifteen (15) <br />consecutive shifts, the City may make a temporary appointment to <br />fill such vacancy. Temporary appointment may continue for a period <br />of one hundred eighty (180) calendar days and may be extended by <br />the Personnel Officer for an additional period of ninety (90) calendar <br />days. For the purpose of Government Code section 20480, an out- <br />of-class appointment shall not exceed a total of nine hundred sixty <br />(960) hours in a fiscal year. <br /> <br />7.10.4 For purposes of this Section (7) a "vacancy” is defined as either an <br />unfilled budgeted position whose incumbent is on paid or unpaid <br />authorized leave, either one of which continues for fifteen (15) or <br />more consecutive shifts. <br /> <br />7.11 Special Department Assignment Pay <br /> <br />Each employee in the classification of Fire Fighter/Engineer or Fire Captain who <br />is assigned by the Fire Chief to a forty (40)-hour workweek while working on a <br />special department assignment shall continue to receive compensation as <br />outlined in Section 7.5.1. <br /> <br />Special department assignments shall not exceed ninety (90) calendar days, <br />except by mutual agreement between the City and the Association. <br /> <br />7.12 Educational Incentive <br /> <br />Education Incentive pay provided in this Section 7.12 shall be considered wages <br />for the purposes of computing overtime and, holiday in lieu pay, and CalPERS <br />retirement benefits in accordance with CalPERS regulations. <br /> <br />Employees must earn all qualifying college credits at an accredited college or <br />university, including specified credits in the field of Fire Science. <br />6.A. - Page 29 of 99 <br />36
