ATTY/ORD.0010/CC ORD AMENDING MUNI CODE CH.18, 27A, 30 <br />REV: 09-17-24 VR <br />Page 2 of 3 <br />update and clarify the requirements for processing various maps and related applications; <br />and to streamline approval of map applications by eliminating the Subdivision Committee <br />and allowing certain applications to be approved at the staff level (the “Chapter 30 <br />Amendments”); and <br /> <br />WHEREAS, the Chapter 18 Amendments, Chapter 27A Amendments, and <br />Chapter 30 Amendments (collectively, the “Municipal Code Amendments”) are in the best <br />interest of the City, and Article XI, Section 7 of the California Constitution allows cities to <br />make and enforce local ordinances and regulations not in conflict with the general laws <br />of the state; and <br /> <br />WHEREAS, adoption of the Municipal Code Amendments is not a project as <br />defined by the California Environmental Quality Act (“CEQA”) pursuant to CEQA <br />Guidelines section 15378 because it does not have any potential for resulting in either a <br />direct physical change in the environment or a reasonably foreseeable indirect physical <br />change in the environment and it involves only organizational and administrative activities <br />of the City; it does not involve or otherwise authorize any construction or physical activity <br />that could impact the environment; and <br /> <br />WHEREAS, even if adoption of the Municipal Code Amendments was considered <br />to be a project under CEQA, it would be exempt from CEQA review pursuant to CEQA <br />Guidelines section 15061(b)(3) because it can be seen with certainty that there is no <br />possibility that adoption of the Municipal Code Amendments would have a significant <br />effect on the environment given that they do not involve or authorize any construction or <br />physical activity that could impact the environment; and <br /> <br />WHEREAS, the City Council of the City of Redwood City considered the Municipal <br />Code Amendments at its regular meeting of October 14, 2024 along with the staff report, <br />supporting documentation, staff presentations, public comment, and information included <br />in the record. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. Adoption of the Municipal Code Amendments is not a project as defined <br />by the CEQA pursuant to CEQA Guidelines section 15378 because it does not have any <br />potential for resulting in either a direct physical change in the environment or a reasonably <br />foreseeable indirect physical change in the environment and it involves only <br />organizational and administrative activities of the City; it does not involve or otherwise
