ATTY/RESO.0025/PC RESO ADOPT AMENDMENTS TO THE ZONING CODE – 2023-2031 HOUSING ELEMENT <br />REV: 06-20-24 VR <br />Page 3 of 4 <br />WHEREAS, the Planning Commission is required to make a recommendation on <br />amendments to the Zoning Code to the City Council. Modifications to the various Articles <br />listed herein would further the purposes of the Housing Element, the El Camino Real <br />Corridor Plan, and the Zoning Code; and <br /> <br />WHEREAS, on May 24, 2024, a public notice of these amendments was circulated <br />in the San Mateo Daily Journal; and <br /> <br />WHEREAS, on June 4, 2024, the Planning Commission held a duly noticed public <br />hearing, in accordance with all applicable requirements of the Redwood City Zoning <br />Code, to consider the Zoning Code Amendments shown in Exhibit A. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> <br />Section 1. Recitals. The recitals set forth above are true and correct and are <br />hereby incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. Findings. In accordance with all requirements of Article 49 of the <br />Zoning Code, the Planning Commission hereby finds that the proposed Zoning Code <br />Amendments are in the public interest, are consistent with the Redwood City General <br />Plan, and increase the quality of the provisions of the Zoning Code in guiding and <br />regulating the future development, growth, and evolution of Redwood City. <br /> <br />Section 3. Compliance with CEQA. The proposed Zoning Code Amendments <br />have been reviewed with respect to applicability of the California Environmental Quality <br />Act ("CEQA") and the State CEQA Guidelines (California Code of Regulations, Title 14, <br />Sections 15000 et seq.). <br /> <br />a. The Zoning Code Amendments related to the implementation of the Housing <br />Element were analyzed in, are contemplated by, and are consistent with the <br />program analyzed in the Focused General Plan Update EIR under CEQA <br />Guidelines 15168(c) and do not require preparation of a supplemental or <br />subsequent EIR under CEQA Guidelines sections 15162 and 15163. The <br />Focused General Plan Update EIR, incorporated herein by reference includes <br />a statement of overriding considerations and a Mitigation Monitoring and <br />Reporting Program which remain applicable. <br /> <br />b. The proposed zoning code maintenance amendments and zoning code <br />amendments to implement the El Camino Real Corridor Plan regarding <br />childcare are not considered a “project” under CEQA Guidelines section 15378 <br />because they are administrative actions consistent with adopted plans and <br />policies that do not authorize any new construction or other activities that could <br />impact the environment. Even if they were considered to be a project, they are <br />exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) <br />because it can be seen with certainty that there is no possibility that the action
