<br />5 <br /> <br />Access shall be restricted so as not to interfere with the normal operations of the <br />department or with established safety or security requirements. Solicitation of <br />membership and activities concerned with the internal management of the <br />Association, such as collecting dues, holding membership meetings, campaigning <br />for office, conducting elections and distributing literature shall not be conducted <br />during working hours unless approved in advance by the City Manager or their <br />designated representative. <br /> <br />3.6 New Employee Orientation <br /> <br />The City shall provide the Association with ten (10) calendar days’ advance notice <br />of the start date of any new hire to a represented classification. An exception to the <br />ten (10) calendar days’ advance notice requirement may be made is if there is an <br />urgent need for meeting in less than ten (10) calendar days’ that is critical to the <br />City’s operations and is not reasonably foreseeable. <br /> <br />The City shall provide the Association with an exclusive one (1) hour meeting with <br />any new employee or group of employees covered by this MOU, during the City - <br />scheduled employee orientation. The specific date, time, and location of the one <br />(1) hour Association meeting with new employees will be coordinated by the Chief <br />of Police and the President of the Association. <br /> <br />The City and Association acknowledge that this Agreement, once implemented by <br />both Parties, fully complies with and exhausts the Parties’ obligation to negotiate <br />pursuant to Government Code Section 3557. <br /> <br /> <br />SECTION 4. CITY RIGHTS <br /> <br />To insure that the City is able to carry out its constitutional, chartered and statutory <br />functions and responsibilities, nothing contained herein shall be construed to require the <br />City to meet and confer on matters which are solely a function of management, including <br />the right to direct the work force; to select and determine the number and types of <br />employees required; to determine the content of job classifications; to hire, transfer, <br />promote, suspend, discipline and discharge employees; to assign work to employees in <br />accordance with the requirements of the City; to establish and change work schedules and <br />assignments; to lay off employees for lack of work; to expand or diminish services; to <br />subcontract any work or operations; to determine and change methods of operations; to <br />determine and change work locations and the processes and materials to be employed; to <br />take all necessary actions to perform its functions in emergencies. <br /> <br /> <br />SECTION 5. ASSOCIATION REPRESENTATIVES <br /> <br />City employees who are official representatives or unit representatives of the Association <br />shall be given reasonable time off with pay to attend meetings with management <br />representatives, labor conferences, labor training seminars, or to be present at hearings <br />6.I. - Page 17 of 84 <br />247
