<br />9 <br /> <br />When a Police Officer is promoted to Police Sergeant, and when a Police Sergeant is <br />promoted to Police Lieutenant, the employee’s base salary will be increased to the step in <br />the Police Sergeant or Police Lieutenant range that represents no less than a five percent <br />(5%) increase. Any differentials the employee received prior to appointment to Police <br />Sergeant or Police Lieutenant will not be used in calculating the five percent (5%) increase. <br />The differentials that the employee qualifies for as Police Sergeant or Police Lieutenant <br />will be added to the newly promoted employee’s Police Sergeant or Police Lieutenant base <br />salary. In the event that the above formula results in a loss of total adjusted salary, the <br />Police Chief may authorize a promotional increase of up to ten percent (10%). In the event <br />that an employee has been in an acting assignment for more than twelve (12) months <br />immediately preceding the promotion, the Police Chief may authorize a promotional <br />increase of ten percent (10%). If the promotional appointment is made at the second or <br />higher step, the promoted employee shall be eligible for a salary increase in six (6) months <br />following the promotional appointment. <br /> <br />7.4 Overtime <br /> <br />7.4.1 Definition of Contractual Overtime <br /> <br />Contractual overtime for employees represented by the bargaining unit is hours <br />worked in excess of an employee’s regularly scheduled shift. For employees <br />assigned to the 4/10 work schedule, contractual overtime is the authorized time <br />worked beyond the forty (40) hour workweek. For employees assigned to the 3/12 <br />½ work schedule, contractual overtime is the authorized time worked beyond one <br />hundred sixty (160) hours in the Fair Labor Standards Act (FLSA) Section 207(k), <br />28-day work period. The one hundred sixty (160) regular work hours in a 28-day <br />work period includes the employee’s “payback” day as part of the employee’s <br />regularly scheduled shift. Paid leave hours count as hours worked for contractual <br />overtime purposes. <br /> <br />All overtime must be approved by the employee’s supervisor prior to such <br />overtime being worked. <br /> <br />Contractual overtime shall be compensated at one and one-half (1.5) times the <br />employee's rate of pay as defined in Section 7.4.2 of this MOU. <br /> <br />7.4.2 Definition of Overtime Rate of Pay <br /> <br />The overtime rate of pay is defined as one and one-half (1.5) times the total of the <br />employee's regular rate of pay. <br /> <br />7.4.3 Definition of FLSA Overtime <br /> <br />Notwithstanding the definition of contractual overtime in Section 7.4.1 above, the <br />City has established a twenty-eight (28) day work period pursuant to 29 U.S.C. <br />section 207(k) for all eligible law enforcement personnel, regardless of rank. Under <br />this 207(k) work period, FLSA overtime for unit members is hours actually worked <br />in excess of 171 in the 28-day work period. The City’s 28-day 207(k) work period <br />for law enforcement personnel encompasses two (2) bi-weekly pay periods and <br />regularly recurs.
