<br />11 <br /> <br />Any employee who is subpoenaed to court less than five (5) hours before the start of their <br />scheduled shift shall be compensated for the amount of time before the actual shift begins. <br />The five (5) hour court minimum will not apply. <br /> <br />Any off duty employee subpoenaed to a hearing in which their appearance is accomplished <br />by telephone have two options. First, they may appear at the Redwood City Police <br />Department and telephone the hearing officer from the police department and receive <br />compensation as if they attended court in person with a five (5) hour minimum. Or second, <br />they may make the telephone call from any location they wish and receive compensation <br />for the duration of their call or a court minimum of two (2) hours for this type of <br />appearance. <br /> <br />The employee shall be compensated at one and one-half (1.5) times the employee's regular <br />straight-time rate of pay for hours worked in excess of their regularly scheduled hours and <br />for hours the employee is required to spend attending court proceedings. <br /> <br />Court Pay - Telephone Standby <br />An off-duty employee who is assigned to testify in any court proceeding as part of their <br />official duties or is subpoenaed or required by the City to appear in Criminal Court or <br />Civil Court, is not scheduled to be on-duty during any portion of the appearance, and who <br />is placed on telephone standby by an official of the court, will be compensated at the <br />overtime rate for two (2) hours for that day. If the off-duty employee is subsequently <br />called into court from telephone standby, the aforementioned two (2) hours become part <br />of court pay as defined in section 7.6. An off-duty employee cannot receive both Court <br />Pay and Court Pay – Telephone Standby on the same calendar day. <br /> <br />7.7 Uniform Allowance and Safety Equipment <br /> <br />Body armor shall not be required unless a Police Sergeant or Police Lieutenant is working <br />in uniform in an enforcement capacity or taking part in Department range training. For the <br />purposes of this section, Police Sergeants and Police Lieutenants are not considered to be <br />working in an enforcement capacity when appearing in court. <br /> <br />Police Sergeants assigned as a Detective Sergeant or Police Lieutenants assigned as the <br />Investigations Division Commander shall not be required to wear body armor unless they <br />are involved in a pre-planned raid or arrest scenario of an anticipated suspect, or when <br />directed by a supervisor. <br /> <br />Police Sergeants and Police Lieutenants may be excused from wearing body armor when <br />they are functioning primarily in an administrative or support capacity, or when medical <br />clearance has been provided by a valid medical authority. <br /> <br />7.7.1 The City will ensure that all new Police Sergeants and Police Lieutenants have or <br />are provided the following articles of Regular Duty Uniform clothing: <br /> <br />3 pairs of pants <br />3 long-sleeve shirts <br />3 short-sleeve shirts <br />1 underbelt <br />1 cold weather (non-leather) jacket with patches <br />1 dress cap or baseball cap with patch (officer’s choice) <br />6.H. - Page 19 of 72 <br />361
