<br />30 <br /> <br />9.8.4 Bereavement leave applies only in instances in which the employee attends the <br />funeral, or is required to make funeral arrangements, but is not applicable for <br />other purposes, such as settling the estate of the deceased. <br /> <br />9.9 Family and Medical Leave <br /> <br />9.9.1 In accordance with the California Family Rights Act of 1994, Government Code <br />Sections 12940-12951, and the Family and Medical Leave Act of 1993, 29 <br />U.S.C. Section 2601 et seq., qualifying employees are entitled to leave in <br />accordance with City Administrative Policy #45, as periodically amended. <br /> <br />9.9.2 Parental Leave: An employee may be granted, at the Police Chief’s discretion, <br />a leave of absence without pay to fulfill parenting responsibilities for up to one <br />(1) year following the child’s birth or one (1) year following the filing of <br />application for adoption and actual arrival of a child in the home (Parental <br />Leave). <br /> <br /> The combination of pregnancy leave and parental leave shall not exceed one (1) <br />year. <br /> <br />9.9.3 Family Medical Leave and California Family Rights Act Leave will run <br />concurrently with Parental Leave as permitted by law. <br /> <br />9.10 Absence Notification <br /> <br />Failure on the part of an employee to report for duty or notify the designated management <br />official one-half (1/2) hour prior to the employee's scheduled starting time as to a reason <br />why the employee cannot report may subject the employee to disciplinary action. <br /> <br />9.11 Personal Business Leave <br /> <br />Any employee shall be entitled to two (2) days per year of Personal Business Leave for <br />any reason without loss of pay. Such leave shall be deducted from accrued sick leave. Use <br />of Personal Business Leave shall be excluded from the definition of sick leave usage for <br />the purposes of calculating sick leave buyouts. The employee shall provide notice as soon <br />as possible after the need for leave is known. <br /> <br />SECTION 10. HEALTH PLANS <br /> <br />10.1 Medical Insurance <br /> <br />10.1.1 The City agrees to contract with the California Public Employee's Retirement <br />System (CalPERS) for participation under the Public Employees Medical and <br />Hospital Care Act (Government Code Section 22750, et. seq.), for the purpose <br />of providing medical insurance benefits for employees and for qualified <br />“annuitants” as defined by PEMHCA.. Upon the request of the City, the parties <br />will re-open this Section 10.1.1 to provide a different group health plan. <br /> <br />10.1.2 The City's maximum monthly contribution for each eligible, active employee <br />and annuitant for the purchase of medical insurance will be equal to the <br />minimum monthly employer contribution required under PEMHCA.
