The Mixed-Use Downtown Amendments appropriately <br />implement the General Plan’s vision for the Mixed Use–Downtown land use <br />designation as the approved DTPP Plan Wide Amendments allow increases to the <br />office development cap. <br /> <br />b. The Project General Plan Mixed-Use Downtown Amendments are limited <br />to an increase in the allowed office development cap and will not create conditions <br />that would be detrimental to the public health, safety, or general welfare. These <br />amendments would instead enhance the DTPP area by promoting planned, transit- <br />oriented development, including increased office with R&D, Lab uses, a Teen <br />Center/Multi-Purpose space, and a public open space plaza consistent with <br />General Plan goals and policies. The Project will revise the General Plan and <br />DTPP Maximum Allowable Development office cap consistent with the amount of <br />office development previously analyzed by the DTPP SEIR. <br /> <br />Section 5. The City Council hereby approves and adopts the General Plan <br />Amendment as provided in Exhibit A, attached hereto and incorporated herein by <br />reference, to add text shown in underline (example) and delete text shown in strikeout <br />(example). Working in brackets ([example]) is informational only and is not be included in <br />the published General Plan. <br /> <br />Section 6. This Resolution shall be effective upon the effective date of the DTPP <br />Amendment and Development Agreement Ordinance. In the event that the DTPP <br />Amendment and Development Agreement Ordinance do not become effective, the <br />General Plan Amendment shall not be deemed approved. In the event the DTPP <br />Amendment or Development Agreement Ordinance are challenged, the General Plan <br />Amendment shall not be deemed approved unless and until the DTPP Amendment and <br />Development Agreement Ordinance are in full force and effect. <br /> <br />* * * <br /> <br />
